Abstract
Ljudska republika Kitajska je znana kot velesila, ki je zanimiva za mnoge investitorje. Nekdaj je bila znana po pravno neurejenem položaju delavcev. Danes pa je za mnoge tuje investitorje presenetljivo dejstvo, da je delovnopravno področje na Kitajskem urejeno in delavcem nudi ustrezno zaščito. Kljub temu pa je Kitajska dežela mnogih kontrastov. Način sprejemanja zakonov in njihovega izvajanja je z našega vidika nerazumljiv. Velike pa so tudi razlike med razvitim in nerazvitim delom države.
Sodno varstvo kitajskih delavcev je podano in statistike kažejo na velik porast tožb delavcev napram delodajalcem. Reševanje nesporazumov glede zaposlitve se v večini primerov reši v procesu posvetovanja in mediacije, saj se želijo delodajalci izogniti dragim sodnim postopkom.
Socialna varnost kitajskih delavcev je odvisna od podjetja v katerem so zaposleni in od delavcev samih. Država sprejema zakone, zbira in nadzoruje odločitve sprejete s strani lokalnih vlad. Delavci, ki imajo veljavno sklenjene pogodbe o zaposlitvi, so tako varovani s strani države in so v sistemu socialnega zavarovanja. Vendar njihovo zavarovanje sega samo do višine zneska akumuliranih prispevkov. Tako lahko npr. delavec, ki zboli uporabi sredstva iz prispevkov za zdravstveno zavarovanje samo do višine sredstev, ki so se za ta namen akumulirala v času njegove delovne dobe. Vsakemu delavcu je prepuščeno, da si dodatno nalaga finančna sredstva ali sklene dodatna zasebna zavarovanja. Zato je za kitajske delavce pomembno, da se bodo zaposlili pri podjetjih, ki se držijo zakona ter v mestih, ki imajo predpisane visoke prispevke.
Diplomsko delo je namenjeno predstavitvi nekaterih bistvenih značilnosti kitajskega delovnega prava.

The People's Republic of China is a country interesting for many foreign investors. Formally known as a country with an unregulated labor law and no security for its workers. Today it comes as a surprise for many foreign investors that the People's Republic of China has regulated its labor law and the chines workers and the law protects the Chinese workers. Nevertheless, the People's Republic of China is a country of many contrasts. The adaptation and implementation of the laws is for us incomprehensible. The difference between the developed part of the country and the undeveloped part are huge.
The law protects the Chinese workers and the statistics show a large increase in lawsuits against employers. The most common resolution of an employment dispute is resolved in the process of consultation and mediation, because employers want to avoid the costly legal expenses.
Social security of the Chinese workers depends on the companies where they work and of the workers themselves. The Chinese government is adopting laws, which are adopted to protect the Chinese workers it collects and monitors the decisions made by the local government. Workers who have a valid labor contract are protected by the state and are in the social security system. However, their protection extends only up to the amount of accumulated contributions during his working period. For example, workers who need health treatment can use their health insurance, but only up to the amount, which has been collected for this purpose during his working period. Every worker is left to impose additional funds or enter into additional private insurance. Therefore, for Chinese workers it is of extreme importance to be employed in companies that follow the law and that they work in cities, which impose higher contributions.
The main purpose is to present some basic characteristics of the Chinese labor law. |
