Abstract

Diplomsko delo obravnava institut pridržka javnega reda v navezavi s tujimi arbitražnimi odločbami. Opisan in razložen je postopek priznanja in izvršitve tujih arbitražnih odločb, razložene so formalne in meritorne predpostavke, opisan je izvor javnega reda. Razložen je materialni, procesni, nacionalni in mednarodni javni red. Večji del diplomskega dela predstavlja aktualna sodna praksa v zvezi s pridržkom javnega reda pri priznavanju tujih arbitražnih odločb, ki je omejena na odločbe držav članic Evropske unije od leta 2000 dalje. Newyorška konvencija iz leta 1958 predstavlja enega izmed temeljnih dokumentov na področju mednarodne trgovinske arbitraže, zato je razlaga pridržka javnega reda v močni navezavi z navedeno konvencijo.

Secondary abstract: The thesis deals with the institute of public policy in connection with foreign arbitration awards. The procedure for recognition and enforcement of foreign arbitral awards, the procedural and substantive assumptions and the origin of public policy are described and explained as well. The thesis also focuses on the material, process, national and international public policy. The greater part of the thesis deals with the current case law on the subject of public order in the recognition of foreign arbitral awards, which is limited to the decision of the Member States of the European Union since 2000. The New York Convention of 1958 is one of the basic documents in the field of international commercial arbitration, so the interpretation of the reservation of public order is strongly connected to the Convention .
