Abstract
Physician Orders for Life-Sustaining Treatment (POLST) je institut ameriškega prava, katerega glavni namen je izboljšanje kakovosti paliativne oskrbe bolnikov, ki se bližajo koncu svojega življenja. Spodbuja aktivno sodelovanje med pacientom in zdravnikom in omogoča oblikovanje pravno zavezujočih zdravniških navodil, ki naj bodo spoštovana v najbolj kritičnih trenutkih zdravljenja.
POLST kot koncept vključuje program uporabe in poseben obrazec. Prvotno se je pojavil v ameriški zvezni državi Oregon leta 1991. Danes je vzpostavljen in z manjšimi variacijami deluje vsaj v šestnajstih zveznih državah. Kot institut s krajšo pravno tradicijo je s strani ameriške javnosti deležen številnih kritik, tako pozitivnih kot negativnih.
POLST je nastal kot odgovor na aktualna vprašanja medicinskega prava. Gre za vprašanja, ki si jih postavljamo tudi pri nas. Kljub velikim razlikam med kontinentalnimi in anglo-ameriškimi pravnimi redi lahko med slovensko in ameriško pravno ureditvijo potegnemo številne vzporednice. Z Zakonom o pacientovih pravicah, ki je bil sprejet 26. 2. 2008, je Slovenija naredila velik preskok v procesu razvoja pravic pacientov. Pridružila se je izbranemu krogu držav, ki so se odločile temeljne pravice pacientov konkretizirati s posebnim zakonom. Zakon temelji na pacientovi svobodi odločanja o sebi, kar predstavlja tudi vrhovni postulat sodobnega medicinskega prava.

Physician Orders for Life – Sustaining Treatment (POLST) is an institute of American law, the basic purpose of which is improvement of palliative care of patients approaching the end of their life. It encourages active cooperation among a patient and a doctor and enables formation of legally binding medical instruction, which shall be respected in the most critical moments of treatment.
POLST as concept includes a programme of use and a special form. Initially, it appeared in the federal state of Oregon in 1991. Presently, it is established and it operates with slight variations in more than sixteen federal states. As an institute with shorter legal tradition, it is criticized by American public. The critiques are positive as well as negative.
POLST was established as an answer to the current questions of medical law. These are questions that we also ask ourselves in our country. Despite the big differences among continental and Anglo-American legal regulations, numerous parallels can be set among the Slovenian and American legal regulation. Slovenia made a great leap in the process of patients´ rights development with Patient Rights Act, which was adopted on 26 February 2008. It joined a group of countries that decided to concretise fundamental patients´ rights with a special law. The law is based on patient´s freedom of choice about themselves, which also represents the supreme postulate of modern medical law. |
