Abstract

Postopki alternativnega reševanja sporov postajajo vse bolj prepoznavni tudi na področju razreševanja sporov v gospodarstvu. Alternativno reševanje sporov predstavlja alternativo sodnim postopkom, saj gre za način mirnega reševanja sporov brez zavezujoče odločitve sodišča. Podjetja lahko nastale spore učinkovito rešujejo s postopkom mediacije, ki velja za najbolj razširjen postopek alternativnega reševanja sporov. Gospodarske družbe in podjetja se za postopek mediacije v splošnem odločajo predvsem zaradi nizkih stroškov postopka, prihranka časa, ohranitve dobrega poslovnega odnosa z nasprotno stranko, dobrega imena in poslovnega ugleda. Prav tako pa pri odločitvi za uporabo mediacije v gospodarstvu predstavlja veliko vlogo zagotovitev zaupnosti samega postopka, kar je iz vidika nadaljnjega delovanja gospodarskih družb velikokrat zelo pomembno. S pomočjo mediacije je sprtim stranem dana možnost, da skupaj ob sodelovanju mediatorja najdejo najbolj optimalno rešitev, ki je usmerjena v prihodnost. S pomočjo mediacije se spori, ki nastajajo v podjetjih, razrešijo na bolj »civiliziran« način, saj se tako vodstvu kot tudi drugim sodelavcem v podjetju prihrani veliko časa in energije, hkrati pa se ohranja delovna motivacija ter se krepijo pozitivni odnosi in dobro vzdušje tako med zaposlenimi kot med poslovnimi partnerji.

Secondary abstract: Alternative ways of resolving disputes are becoming more are more recognizable also when settling conflicts in the field of economy. Alternative ways of resolving disputes is an alternative solution for judicial procedures, as this is a way of peaceful settlement of conflicts without a binding decision of a court. Companies can successfully resolve conflicts through mediation procedure which is the most common procedure among alternative ways of resolving disputes. Companies mainly choose the mediation procedure due to the following reasons: low cost of the procedure, time savings, maintaining good business relation with the conflicting party, preserving good name and business reputation. When choosing mediation procedure in economy, providing the confidentiality of the procedure itself is of great importance, since that procedure is often very important as far as the future operations of companies are concerned. With the help of mediation and the mediator, parties in conflict can find the best solution, looking at the future, together. Mediation is a way of resolving disputes in companies in a “civilized” manner, since it saves a lot of time and energy of the management and other workers of the company. At the same time, work motivation, positive attitude and good atmosphere remain present as far as the employees and business partners are concerned.
