Abstract

Diplomsko delo obravnava vlogo naročnikov v pravnem varstvu v postopkih javnega naročanja. Predstavljena je zakonska ureditev tega področja in sicer v zaporedju, kot pravno varstvo ureja zakon in kot dejansko poteka v praksi. Uvodoma je kratko pojasnjen namen javnega naročanja, zakonodaja, ki ga ureja in osnovni instituti javnega naročanja, enako velja za pravno varstvo v javnem naročanju. Nadalje sledi predstavitev celotnega postopka pravnega varstva pri javnem naročanju, ki se deli v na dve stopnji. Na prvi stopnji odloča naročnik, ki na drugi stopnji postane stranka v postopku, kjer odloča Državna revizijska komisija. Kot podlaga za uveljavljanje pravnega varstva, torej za vložitev zahtevka za revizijo, je opredeljeno nezakonito ravnanje naročnika v postopku izvajanja posamičnega javnega naročila. Za predrevizijski postopek so opredeljeni roki za vložitev zahtevka za revizijo, posledice vložitve, možnost umika ter ostale procesne aktivnosti strank. Predstavljeno je ravnanje naročnika z vloženim revizijskim zahtevkom, od njegove preverbe do identifikacije aktivne legitimacije ter obveznosti posredovanja izbranemu ponudniku v posebnih situacijah. V zvezi z odločitvijo naročnika so opredeljeni roki za njeno izdajo, pregled situacije, ko naročnik ne izda odločitve ter opredelitev možnosti nadaljevanja postopka pravnega varstva v revizijskem postopku. V predstavitvi revizijskega postopka gre za opredelitev ravnanj Državne revizijske komisije v zvezi z vloženim revizijskim zahtevkom. Nadalje so opredeljeni še postopek s pritožbo, odločanje o stroških, določanje višine taks, sodno varstvo ter izjeme od pravnega varstva. V sklepu diplomskega dela pa sta obravnavani hipotezi in sicer glede ustreznosti slovenske ureditve pravnega varstva pri javnem naročanju glede na evropsko direktivo ter glede hitrosti odločanja.

Secondary title: The role of contracting authorities in legal protection in public procurement procedures
Secondary abstract: Thesis deals with the role of contracting authorities in legal protection in public procurement procedures. Presented is the legislation in this field in the sequence as legal protection is regulated by law and as it is actually carried out in practice. Firstly the purpose of public procurement is briefly explained, the same goes for its legislation and basic institutes of public procurement. The same applies to legal protection in public procurement. Furthermore, a presentation of the whole process of legal protection in public procurement follows It is divided into two instances. In the first instance, the contracting authority is the decision maker and then in the second instance it becomes a party to the proceedings, where the National Review Commission for Reviewing Public Procurement Award Procedures is the decision maker. A basis for the application for a legal protection, or a review, is an unlawful conduct in the procedure of carrying out of the individual procurement. For the first instance a definition of deadlines is given, listed are the consequences of filing the review demand, the possibility of withdrawal and other procedural actions of the parties. Presented are the contracting authorities’ actions, regarding the application for a review, firstly its verification, then the identification of locus standi and the obligation to inform the successful tenderer in some situations. Regarding the decision of the contracting authority deadlines for its delivery are defined, overview of the situation when the client does not issue decisions is given and finally the possibilities of continuing the process of legal protection are identified. In the presentation of the second instance procedure a definition of the practices of the National Review Commission are given. Further presented is the appeal procedure, ruling on costs, determining the amount of fees, legal protection in front of the court and exemption from justice. In conclusion, the thesis discusses two hypotheses, namely regarding the adequacy of the Slovenian regime of legal protection in public procurement in relation to the European directive and the speed of decision-making.
