Abstract

Namembnost zemljišča nam pove, ali je gradnja na zadevajoči površini dovoljena ali ne. Veliko ljudi vidimo graditi hiše, vendar pa vsi tega ne morejo storiti, saj jih pri tem ovira prav namembnost zemljišča, ki je določena v prostorskih aktih občine. V kolikor parcela oziroma zemljišče ni gradbeno, moramo za gradnjo pridobiti gradbeno dovoljenje, še pred tem pa moramo na občino vložiti vlogo za spremembo namembnosti zemljišča. V postopku obravnave zadevne vloge občina le-to preuči in v primeru odobritve sledi sprememba prostorskih planov in območij stavbnih zemljišč. Po opravljenem postopku je potrebno plačati odškodnino, ki pa se je od spremembe ZKZ-ja (Zakona o kmetijskih zemljiščih) v letu 2012 drastično zmanjšala. Cilj diplomskega dela je, opisati, kako iz nezazidljivega oziroma kmetijskega zemljišča spremeniti namembnost v zazidljivo oziroma stavbno zemljišče. Predstavil bom tudi postopek spremembe namembnosti kmetijskega zemljišča v stavbno zemljišče, ki zajema, na kaj mora biti vlagatelj pred oddajo vloge pozoren, kje lahko pridobi potrebne informacije in katera dovoljenja potrebuje. Obravnavana bo tudi enačba za izračun odškodnine zaradi spremembe namembnosti in druge pomembne stvari za zadevno spremembo.

Secondary abstract: Intended use of land tells us if building on concerned surface is allowed or not. We see many people building their houses, but not all of them can do it, precisely because of intended use of land determined in municipal spatial planning documents. Insofar as plot or land is not building plot/land, one first has to get building permission, but just before that one has to file application for change of intended use. In the handling process of this application, municipality examines it and in the case of approval follows change of municipal spatial planning documents and change of building lands. After the completed process, one needs to pay compensation for this purpose, which had drastically changed (reduced) since Agricultural Land Act amandment in year 2012. Objective of this diploma thesis is to describe how to change intended use of agricultural land to residential land/ construction land. I will as well took an interpretation and description of the process of change of intended use of agricultural to residential use, which includes on what one has to pay attention before lodging an application, where can applicant get needed information and which permissions does one need. I will also address equation for calculating compensation for changed intended use and other important information related to diploma thesis.
