Abstract
Področje skupinskega uveljavljanja zahtevkov je pomembno z vidika varstva pravic kolektivnih interesov potrošnikov, saj jim je na ta način omogočeno varstvo njihovih pravic, ki jih drugače posamezno ne bi mogli doseči. Antitrust poleg tega, da prizadene konkurenco na notranjem trgu Evropske unije, povzroča škodo tudi potrošnikom. Posamezniku sicer povzroči majhno škodo, na koncu pa seštevek vseh posameznih škod predstavlja velik dobiček določenim gospodarskim subjektom. Skupinska tožba je tožba, ki jo več posameznikov naperi zoper enega ali več tožencev kot eno tožbo. Skupinsko tožbo pravno ureja Direktiva 2009/22/ES in Zakon o varstvu potrošnikov. Za področje zasebnega uveljavljanja konkurenčnega prava Evropske unije je pomembna Uredba št. 1/2003, ki omogoča posameznikom sklicevanje na protimonopolna pravila pred nacionalnimi sodišči. Vsebina diplomskega dela je osredotočena predvsem na področje skupinske tožbe, ki predstavlja odgovornost za posledice protimonopolnih ravnanj gospodarskih subjektov. Zaradi kršitev konkurenčnega prava je pomembna tudi Direktiva 2014/104/EU, ki ureja nacionalne ureditve odškodninskih tožb. Cilj Direktive je vzpostavitev učinkovitega sistema izvajanja kršitev konkurenčnega prava v zasebnem interesu.

Scope of collective enforcement of claims is important in terms of protecting the rights of the collective interests of consumers, because they were given the opportunity to defend their rights by other individual could not be reached. Antitrust addition to affecting competition in the internal market of the European Union, causing injury to consumers. Individual otherwise cause little damage in the end the sum of all individual claims represents a significant gain certain traders. A class action lawsuit was brought by several individuals spokes against one or more defendants than one action. Collective action legally covered by Directive 2009/22/EC and the Consumer Protection Act. In the field of private enforcement of competition law, the European Union is important in Regulation No. 1/2003, which allows individuals a reference to the antitrust rules before national courts. The content of the thesis is focused mainly on the scope of the class action, which is responsible for the consequences of antitrust practices of operators. Due to the breach of competition law it is also important to Directive 2014/104/EU, which regulates the national scheme of actions for damages. The Directive aims to establish an effective system of implementation of competition law infringements in the private interest. |
