Abstract

V diplomskem delu se avtorica ukvarja z vprašanjem kaznivih dejanj, ki jih lahko storilci izvršijo zoper izvršitelja, ko ta opravlja izvršilna dejanja. V uvodnem delu so najprej predstavljeni splošni kazenskopravni instituti, ki so pomembni za razumevanje kaznivega dejanja. Drugi osrednji del namenja na kaznivemu dejanju preprečitve uradnega dejanja in maščevanja uradni osebi. Pri tem v vlogo uradne osebe, kot oškodovanca postavi izvršitelja. Izvršitelj je zaradi opravljanja izvršilni dejanj s katerim posega v najbolj občutljivo sfero posameznikov, ki se znajdejo kot dolžniki, to je v njihovo lastninsko pravico, pogosto oškodovanec. Skozi analizo zakonskega opisa kaznivega dejanja preprečitve uradnega dejanja in maščevanja uradni osebi, želi ugotoviti ali je storilcem slednjega mogoče pripisati in pod kakšnimi pogoji.

Secondary abstract: The author deals with the question what sorts of criminal offences perpetrators can execute against private bailiff while he is performing his enforcement duty. In the preface of this paper we will firstly introduce the general legal institutes of criminal law, which are important for understanding of the legal notion called criminal offence. In central part of this paper intends to represent criminal offence of obstructing the performance of official acts or revenge upon an official. In this paper is Bailiff exposed as the leading role of the term official, because of his injured party status. Private bailiff status as injured party is established for performing his enforcement duty, which nature is to encroach upon someone’s rights, that mostly effect debtors, as example, in their private property. Through the analysis of the legal elements of the criminal offence of obstructing the performance of official acts or revenge upon an official we will determine if and under what conditions the criminal offence can be imputed to the perpetrator.
