Abstract

V diplomskem delu predstavljam posameznika kot refleksnega in specifičnega individuuma ter njegovo vlogo, položaj in udeležbo v mednarodnem pravu. Posameznik je nedvomno subjekt nacionalnega prava, nosilec pravic in obveznosti, vendar mnenja teoretikov glede njegove vloge v mednarodnem pravu niso enotna. Prihaja do različnih razprav, obstaja pa tudi veliko dilem, kakšen je odnos posameznika z mednarodnim pravnim redom in kaj prinaša prihodnost na tem področju mednarodnega prava. V nekaterih primerih, sploh v novejšem času, mednarodno javno pravo in mednarodno kazensko pravo združujeta moči. Posledično je tudi posamezniku priznana določena raven mednarodnopravne subjektivitete – poleg različnih pravic in svoboščin, ki jih mednarodno pravo pridržuje posamezniku, ima človek tudi odgovornost, zlasti tisto, ki nastane na podlagi mednarodnih kaznivih dejanj.

Secondary abstract: In the final paper, I present the individual as a reflexive and specific individual, as well as its role, position and participation in the international law. The individual is undoubtedly a subject of the national law and a holder of rights and obligations. However, the opinions of theoreticians regarding the role of the individual in the international law are not uniform. There have been various discussions and numerous dilemmas regarding the relationship of the individual with the international law acquis and relating to what the future holds for this area of the international law. In some cases, especially more recently, public international law and international criminal law have been joining forces. Consequently, the individual is granted a certain level of international legal subjectivity – in addition to various rights and freedoms that the international law grants to the individual, the individual also has responsibilities, in particular those arising from international criminal offences.
