Abstract
Namen diplomske naloge je predstaviti problematiko mednarodne ugrabitve otrok in opisati delo in pomen mediatorja Evropskega parlamenta v primeru mednarodne ugrabitve otroka.
Na začetku je predstavljenih nekaj bistvenih pojmov s področja mednarodnih ugrabitev, in sicer pojem otroka, starševske odgovornosti (predvsem, kako je s starševsko odgovornostjo, ko pride do razveze zakonske zveze ali življenjske skupnosti), pojem ugrabitve ter mednarodne ugrabitve.
V nadaljevanju je predstavljena pomembna zakonodaja oziroma pravni akti, ki zadevajo področje mednarodnih ugrabitev. Tu sta izrednega pomena Konvencija o civilnopravnih vidikih mednarodne ugrabitve otrok in Uredba Bruselj II bis, ki najobsežneje pokrivata področje te problematike, nekaj besed pa sem namenila tudi Konvenciji Združenih narodov o otrokovih pravicah.
V zadnjem poglavju je podrobneje predstavljena mediacija kot alternativni način reševanja sporov, načela mediacije in njen potek. Predstavljeno je tudi delo mediatorja Evropskega parlamenta v primerih mednarodne ugrabitve otrok ter razlogi za zavrnitev vrnitve otroka.

The aim of this thesis is to present the issue of international child abduction and describe the work and importance of the mediator of the European Parliament in the case of international child abduction.
At the beginning I presented a number of essential concepts in the field of international abduction, namely the concept of a child, parental responsibility (particularly when it comes to divorce or separation), the concept of international abduction and kidnapping.
I described the relevant legislation which concerns the international abduction. At the utmost importance are the Convention on the Civil Aspects of International Child Abduction and the Brussels II bis Regulation, which comprehensively cover the scope of this problem. I also described the role of United Nations Convention on the Rights of the Child.
The last chapter presents mediation as an alternative method of dispute resolution and the principles of it. I described the work of the mediator of the European Parliament in cases of international child abduction and the reasons for refusing the return of a child. |
