Abstract

Diplomsko delo se v svojem bistvu ukvarja s človekovimi pravicami in njihovim zgodovinskim razvojem. Opisuje začetke razvoja človekovih pravic, ki sežejo daleč nazaj v obdobje pred našim štetjem, in izpostavlja Dekalog v obdobju krščanstva, ki predstavlja prvi pisni vir z idejo o enakosti vseh ljudi. V nadaljevanju so navedeni pomembni mejniki v obdobju od srednjega veka do 20. stoletja, ki jih predstavljajo kodificirane listine, kot so Magna Charta Libertatum, Habeus Corpus, Virginjska deklaracija ter druge. Diplomsko delo nadalje razlikuje pravno urejenost na evropski, regionalni in nacionalni ravni ter ugotavlja kakšna je korelacija, na področju varovanja človekovih pravic, med slovenskim nacionalnim pravnim redom in pravnim redom Evropske unije. Za temeljni problem v okviru varstva človekovih pravic v zgodovini kot tudi v današnjih družbenih razmerah izpostavlja diskriminacijo. V svojem zadnjem delu razloži pojma negativna in pozitivna diskriminacija, poda strokovno razlikovanje med različnimi oblikami in vrstami diskriminacije, ki so podkrepljene s primeri, ter poišče posamezne določbe v slovenskih pravnih aktih, ki bodisi negativno bodisi pozitivno diskriminirajo posameznike ali skupine ljudi. V sklepnem delu avtor diplomskega dela izpostavi ključne ugotovitve, do katerih je prišel s pomočjo raziskovanja človekovih pravic v okviru nastajanja diplomskega dela.

Secondary abstract: The thesis is about human rights and their historical development. It describes the beginnings of it, which go way back to times before Christ, and exposes The Decalouge as one of the first written sources wtih an idea of human equality. It describes important milestones from Middle Ages to 20th century, represented by codifications such as, Magna Charta Libertatum, Habeus Corpus, Virginia Declaration of Rights and others. Furthermore the thesis shows differences between legal systems on regional, European and national levels which regulate human rights and shows the corelation between European and Slovenian natioanl law regarding protection of human rights. As the main problem throught the history and today it exposes discrimination as one of the biggest concerns. It explains the definiton of negative and postive discriminaton. Gives a description of different types of discriminaton, wich also include practical cases and finds regulations in Slovenian law, that regulate postitive and negativie discriminaton of people. In it`s last part the thesis sums up the main findings that were reached by author.
