Abstract

Namen diplomske naloge je prikazati trenutno pravno ureditev brezpilotnih letal - dronov v Evropski Uniji (EU) in Republiki Sloveniji (RS) iz različnih področij. V nalogi so zajeta samo civilna brezpilotna letala. Zaradi prenesene pristojnosti zakonodajnega urejanja brezpilotnih letal iz institucij EU na nacionalno raven ugotavljam, da države različno pravno urejajo brezpilotna letala, s tem pa so pred operaterje tovrstnih proizvodov postavljene dodatne ovire, zlasti glede vključevanja v zračni prostor, v katerem poteka letalski promet. Omejitve so potrebne predvsem zaradi varnosti vseh udeležencev, zaradi česar se mora vzpostaviti primeren sistem šolanja upravljavcev in sistem registracije brezpilotnih letal. Z brezpilotnimi letali je mogoče opravljati različne naloge, ena izmed njih je tudi zbiranje osebnih podatkov. Obstoječa mednarodna in nacionalna zakonodaja iz področja varstva zasebnosti in varovanja osebnih podatkov zajema tudi brezpilotna letala in je po moji oceni ustrezna. Prihodnost vključevanja brezpilotnih letal v zračni prostor je potrebno doseči s čim bolj enotno mednarodno zakonodajo. Letalska zakonodaja se tako pospešeno razvija, njen razvoj pa je vezan tudi na druge pravne veje, zlasti civilno, kazensko, gospodarsko in upravno pravo. Načrt EU je, da se do leta 2024 izvede popolna integracija brezpilotnih letal v celoten zračni prostor. Kako dobro je uspela integracija brezpilotnih zrakoplovov bo vidno kmalu, skozi statistiko letalskih nesreč. Upajmo, da bo teh čim manj.

Secondary abstract: The aim of the thesis is to show the current regulation of unmanned aircraft – drones in the European Union (EU) and the Republic of Slovenia (RS) in various fields. The project covers only civilian drones. Because of the delegated powers of legislative regulation of unmanned aircraft from the EU institutions to the national level, I note that countries are governed by different legislative for drones, and thus the operators of such products encounter additional obstacles, particularly with regard to the inclusion in the airspace through which the aircraft will pass. Restrictions are needed mainly for the security of all participants; therefore it is necessary to establish a proper system of training for operators and a registration system of unmanned aircraft. The drones can perform a variety of tasks, one of which is the collection of personal data. The existing international and national legislation in the field of protection of privacy and protection of personal data also includes drones, and in my opinion, in an appropriate way. Future integration of unmanned aircraft in the airspace is necessary to achieve a uniform international law. The Aviation Legislation is also developing fast; its development is linked to other legal branches, especially civil, criminal, commercial and administrative law. The EU plan is to perform a complete integration of unmanned aircraft in the entire airspace by 2014. How well the unmanned aircraft integration has succeeded will soon be visible through statistics of air accidents.
