Abstract
Teoretično izhodišče. V magistrskem delu smo predstavili zgodovinski razvoj pacientovih pravic in pravne podlage za varovanje pacientovih osebnih podatkov. Namen raziskave je proučitev varovanja pacientovih osebnih podatkov (imena in priimka) v čakalnicah Univerzitetnega kliničnega centra Maribor in proučitev mnenja izvajalcev zdravstvene nege, občanov in varuha bolnikovih pravic o zagotavljanju varovanja osebnih podatkov v čakalnicah.
Metodologija raziskovanja. V teoretičnem delu je bila uporabljena metoda analize literature. Viri literature so bili zbrani na podlagi znanstvene in strokovne literature in aktualne zakonodaje. V empiričnem delu je bila uporabljena metoda zbiranja podatkov z anketnimi vprašalniki in intervjujem. V raziskavo je bilo vključenih 195 izvajalcev zdravstvene nege, 150 občanov in varuh bolnikovih pravic. Rezultati so bili statistično obdelani v programu MS Excel, kjer so bile uporabljene metode opisne statistike.
Rezultati raziskovanja. Rezultati so pokazali, da se izvajalci zdravstvene nege v čakalnicah v UKC Maribor poslužujejo različnih načinov naslavljanja pacientov. Nimajo navodila za delo, ki bi opredeljevalo, katere organizacijske in tehnične postopke ter ukrepe naj izvajajo v čakalnicah, da bodo varovali pacientov osebni podatek ime in priimek. Rezultati so pokazali tudi, da 64 % anketiranih občanov želi biti iz čakalnice v ambulanto poklicanih po imenu in priimku, 36 % anketiranim občanom je vseeno in le 10 % želi, da se njihov osebni podatek ime in priimek varuje s klicanjem z zaporedno številko. Od 90 % tistih, ki jim varovanje osebnega podatka imena in priimka v čakalnicah ni pomembno, pa vendarle 2 % ne bi želela, da se osebni podatek razkrije na nekaterih občutljivejših področjih zdravja.
Sklep. Izvajalci zdravstvene nege v UKC Maribor dobro poznajo pravice pacientov, nimajo pa konkretnega navodila za delo, ki bi opredeljevalo organizacijske in tehnične postopke, ki omogočajo varovanje pacientovega osebnega podatka imena in priimka v čakalnicah. V večini primerov se odločajo po lastni presoji in kljub temu, da se zavedajo kazenske odgovornosti ob razkritju pacientovih osebnih podatkov, se v večini primerov odločajo za klicanje pacientov v čakalnicah po imenu in priimku. S prisotnostjo v čakalnici oziroma ambulanti določene specialnosti se posredno razkriva domnevno zdravstveno stanje pacienta. Posamezni primeri, ki jih je obravnaval varuh bolnikovih pravic, pokažejo, da obstajajo občutljivejša področja in ta se tudi ujemajo z navedbami občanov v raziskavi. V večini primerov pa pacienti želijo biti poklicani po imenu in priimku, saj klicanje z zaporedno številko doživljajo kot brezoseben odnos zdravstvenih delavcev.

Protecting patients' personal data in the waiting rooms |

Theoretical background. In this paper we present the historical development of the patients’ rights and the legal basis for its protection. The aim of this research paper was to investigate how well patients’ personal data, such as a name and a surname, were protected in the waiting rooms of the University Medical Centre (UKC) Maribor, and to investigate the opinion of healthcare practitioners, citizens, and the Guardian of the Patients’ Rights’ about the sufficient provision of protecting personal data in the waiting rooms.
Research methodology. The theoretical part of the paper is based on the literature analysis. The sources of literature were gathered based on the scientific and professional relevance, and the current legislation. The empirical part of the paper entailed collecting data with the help of interviews and questionnaires. The research sample was made up of 195 healthcare practitioners, 150 citizens and the Guardian of the Patients’ Rights. The results were statistically analysed with the help of the MS Excel software, using the descriptive statistical methods.
Results. Research shows that the healthcare practitioners in the UKC Maribor make use of different methods of addressing the patients in the waiting rooms. Guidelines describing the technical and organisational steps to take, and detailing the manner in which they are expected to address the patients, so that patients’ personal data is protected, are lacking. Research shows that 64 % of citizens would in waiting rooms like to be addressed by name and surname, 36 % are indifferent, and only 10% prefer their name be numerically codified. Out of the 90 % of those that are indifferent to their name and surname being concealed in the waiting rooms, 2 % would not wish for personal data be publicly revealed in relation to sensitive areas of healthcare.
Conclusion. Healthcare practitioners in the UKC Maribor are well acquainted with the patients’ rights, however, they lack the concrete technical and organisation guidelines as to how to put patients’ privacy rights in practice. In most cases practitioners decide the mode of action themselves, and although they are aware of the criminal liability for disclosing patients’ personal data, in most cases they decide for addressing them with their name and surname. With being in the waiting room or a specialist clinic the patient indirectly discloses the alleged medical condition. Some cases, dealt with by the Guardian of the Patients’ Rights, demonstrate the existence of sensitive healthcare areas. This demonstrations are confirmed by the opinions of citizens. In most cases, however, patients prefer being addressed with their names and surnames, for numerical codification is perceived to be too impersonal of a way of interaction between practitioners and patients. |
