Abstract

V prvem delu diplomske naloge smo se osredotočili na slovensko pravno ureditev policijskega zaslišanja. Poseben poudarek je bil namenjen metodam zasliševanja in zakonskim prepovedim, ki zavezujejo zasliševalce. Predstavili smo novosti, ki jih je prinesla novela ZKP-E (2003), ter opredelili temeljne pravice in pravna jamstva, ki jih ima osumljenec pri policijskem zaslišanju. Drugi del diplomske naloge temelji na predstavitvi sodne prakse Ustavnega sodišča Republike Slovenije in Evropskega sodišča za človekove pravice. Predstavili smo institut ustavne pritožbe in določbe Ustave Republike Slovenije, ki so pomembne za policijsko zaslišanje. Pri sodni praksi Ustavnega sodišča Republike Slovenije smo se osredotočili na odločitve sodišča o ustavnih pritožbah, v katerih se pritožniki sklicujejo na kršitev njihovih pravic pri policijskem zaslišanju. V nadaljevanju smo predstavili institut pritožbe na Evropsko sodišče za človekove pravice in določbe Evropske konvencije o človekovih pravicah, ki so pomembne za postopek policijskega zaslišanja. Pri sodni praksi Evropskega sodišča za človekove pravice smo se osredotočili na kršitve prepovedi mučenja (3. člen) in kršitve pravice do poštenega sojenja (6. člen). Analizirali smo sodno prakso, iz katere je razvidno stališče Evropskega sodišča za človekove pravice glede nezakonitih metod zasliševanja, pravice do zagovornika ter pravice do molka in privilegija zoper samoobtožbo.

Secondary title: POLICE INTERROGATION IN CASE LAW OF THE CONSTITUTIONAL COURT OF THE REPUBLIC OF SLOVENIA AND THE EUROPEAN COURT OF HUMAN RIGHTS
Secondary abstract: At the beginning of the thesis we focused on the slovenian legal framework of police interrogation. Special emphasis was placed on interrogation techniques and legal prohibitions, that interrogators are bound by. We presented innovations brought about by the amendment CPA-E (2003) and defined the fundamental rights and legal guarantees that the suspect has during police interrogation. The second part of the thesis is based on the presentation of the case-law of the Constitutional Court of the Republic of Slovenia and the European Court of Human Rights. We presented the constitutional complaint and the provisions of the Constitution of the Republic of Slovenia, which are important for police questioning. In the case law of the Constitutional Court of the Republic of Slovenia, we focused on decisions of the Constitutional Court of the Republic of Slovenia regarding constitutional complaint in which the complainants allege infringement of their rights in police interrogation. In the following we introduced the complaint to the European Court of Human Rights and the provisions of the European Convention on Human Rights, which are important for the process of police questioning. In the case law of the European Court of Human Rights, we focused on the violation of the prohibition of torture (Article 3) and the violation of the right to a fair trial (Article 6). We analyzed the case law, which shows the view of the European Court of Human Rights regarding illegal methods of interrogation, the right to counsel, the right to remain silent and the privilege against self-incrimination.
