Abstract

V diplomski nalogi bodo predstavljena policijska pooblastila, s katerimi policisti lahko odvzamejo posamezniku osebno svobodo to je pridržanje. Na ta način želimo to problematiko podrobneje predstaviti tako strokovni kot tudi splošni javnosti, ki včasih zaradi napačne predstavitve primerov policijskega pridržanja ne razlikujejo med policijskim pridržanjem in sodnim priporom. Policisti morajo za izvajanje svojih nalog poznati veliko zakonov, če želijo zakonito, strokovno in učinkovito izvesti svoje naloge. Za področje posega v posameznikovo svobodo morajo tako poznati določbe iz Zakona o kazenskem postopku (v nadaljevanju ZKP), Zakona o prekrških (v nadaljevanju ZP), Zakona o nalogah in pooblastilih policije (v nadaljevanju ZNPPOL) in Zakona o pravilih cestnega prometa (v nadaljevanju ZPRCP), da bi lahko bili pri svojem delu strokovni in zakoniti, kar je osnova za izvedbo njihovih nalog. Zaradi neenotnih določil o izvedbi policijskega pridržanja, pa morajo v teh postopkih paziti da do napak ne pride. Zaradi tega, kakor tudi zaradi nenehnih sprememb zakonodaje, ki se spreminja glede na nastale razmer v družbi, se morajo policisti zaradi uspešnega izvajanja svojih pooblastil nenehno izobraževati in usposabljati. Policisti v procesu pridobitve izobrazbe policisti pridobijo le osnovno znanje, ki ga morajo kasneje pri svojem delu dopolnjevati in nadgrajevati na tak način. Cilj naloge je analizirati razvoj policijskih pridržanj in na enem mestu zbrati vse predpise o policijskih pridržanjih, kar bi policistom lahko služilo kot delovni opomnik. Pri tem pa se pregleda in ugotovi ali pri opredelitvi policijskih pridržanj v različnih zakonih prihaja do takšnih neusklajenosti, ki bi zahtevala spremembe in dopolnitve posameznega zakona.

Secondary abstract: This thesis presents the police powers, with which members of the police can put an individual into custody. All of this is an effort to present this topic to a wider audience, proffesional and general public alike because they sometimes have difficulties differentiating between police custody and judicial remand. In order to perform their work legally, professionally and efficiently, police officers have to possess large body of knowledge of the laws they are implementing. For intruding into an individiual's freedom, they have to take into consideration the provisions of The Criminal Procedure Act, Offences Act, Law on the duties and powers of the police and Law on road traffic rules in order to stay in line of proffesionalism and lawfulness, which are the basis of their work. This is made more difficult because of un-unified provisions concerning police custody. That is why, alongside the everchanging legislation due to everchanging social condition, police force has to maintain inner education and training. The force only obtains basic knowledge by the end of their formal education, which has to be revised in the aforementioned manner. Goal of this thesis is to analyze the developement of police detentions and bring all of the provisions concerning police custody into one place, which could serve as a work reminder for the police force. At the same time, these provisions will be revised to see if there are any inconsistencies or conflicts of interest between the provisions, which would require changes and amendments to be made to a particular law.
