Abstract
V diplomski nalogi smo preučili zakonodajo osebnega stečaja v Sloveniji ter ugotovili možnosti zlorabe tega instituta. Zakonodajalec je konec leta 2007 razglasil Zakon o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju (ZFPPIPP, 2007), ki je kot prvi omogočal uporabo osebnega stečaja za dolžnika – fizično osebo, do avgusta 2016 pa je bil večkrat noveliran. Največjo spremembo je omenjeni zakon doživel leta 2013, saj je dolžniku omogočil začetek osebnega stečaja brez plačila predujma in visokih stroškov. Na podlagi analize statističnih podatkov smo ugotovili, da se je posledično uporaba instituta osebnega stečaja v letu 2014 povečala za več kot 200 % v primerjavi z letom 2013. Zakonodajalec je ukinil plačilo sodne takse za začetek osebnega stečaja, kar je sprožilo tudi mnogo špekulacij in zlorab instituta med dolžniki, ki so oddali vlogo za osebni stečaj. To je opazil tudi zakonodajalec, ki je aprila 2016 objavil novelo zakona ZFPPIPP-G z namenom preprečiti zlorabo instituta osebnega stečaja ter nepoštenim dolžnikom onemogočiti odpust obveznosti dolga.

Novelties of the personal bankruptcy legislation |
| Secondary abstract: |
The focus of this thesis is to investigate the legislation of personal insolvency in Slovenia and identify potential fraud and abuse. The so-called Financial Operations, Insolvency Proceedings and Compulsory Dissolution Act (ZFPPIPP, 2007) has been promulgated by the legislature in 2007 and was the first law to allow consumers to resort to personal bankruptcy. Since then the Government of the Republic of Slovenia adopted several amendments to this law, the last reform being introduced in April 2016. Nevertheless, the greatest change was performed in the amendment ZFPPIPP-F in 2013 which enabled the debtors to initiate the personal bankruptcy process without the payment of initial fees and high costs. Based on our statistical data analysis we found that consequently the usage of the mentioned proceeding has increased immensely in 2014, namely it increased by 200% in comparison to year 2013. The latter development brought about numerous doubts of integrity of applicants and called for bankruptcy abuse prevention. This false position was remedied by the legislature with introduction of the last amendment ZFPPIPP-G in April 2016 which incorporated actions and methods for abuse prevention and disabling remission of debt for dishonest debtors. |
