Abstract

Trgovina z ljudmi je globalen problem našega časa, ki grobo krši človekove pravice in se pojavlja v več oblikah. Ena izmed njenih oblik je trgovina s človeškimi organi, tkivi in krvjo. Trgovino s človeškimi organi, tkivi in krvjo ločimo na trgovino z ljudmi z namenom odstranitve organov, potovanja z namenom nezakonitih presaditev organov in trgovino z organi v ožjem smislu. Trgovina s človeškimi organi, tkivi in krvjo nastane zaradi presežka povpraševanja nad ponudbo legalno pridobljenih človeških bioloških materialov. Zaradi pomanjkljive zakonodaje in korupcije je najbolj razširjena v državah tretjega sveta, prebivalci teh držav pa se za prodajo organa odločijo zaradi finančnih težav. V diplomskem delu je trgovina s človeškimi organi, tkivi in krvjo opredeljena in na globalnem nivoju analizirana z metodo analize kriminalističnostrateških dejavnikov. Analiza kriminalističnostrateških dejavnikov trgovine s človeškimi organi, tkivi in krvjo je opravljena za Združeno kraljestvo Velike Britanije in Severne Irske, Republiko Indijo in Ljudsko republiko Kitajsko. Državljani Republike Indije in Ljudske republike Kitajske so na globalnem trgu človeških bioloških materialov večinoma žrtve, državljani Združenega kraljestva Velike Britanije in Severne Irske pa kupci, ki potujejo v države tretjega sveta zaradi presaditev organov. V Združenem kraljestvu Velike Britanije in Severne Irske je zakonodaja na področju presaditve organov ustrezno urejena, nadzor pa multiagencijski. V Republiki Indiji se nadzor izboljšuje, vendar ga omejuje korupcija. V Ljudski republiki Kitajski to področje ni primerno urejeno, saj so državni organi vključeni v trgovino s človeškimi organi, tkivi in krvjo ter potovanja z namenom nezakonitih presaditev organov.

Secondary abstract: Human trafficking is a global problem of our time, which severely violates human rights and occurs in several forms. Trafficking in human organs, tissues and cells is one of its forms. Trafficking in organs, tissues and cells occurs as human trafficking for the purpose of organ removal, travel for illegal organ transplantation and organ trafficking in a narrow sense. Trafficking in human organs, tissues and cells is caused by the surplus of demand over supply of legally acquired human biological materials. Due to insufficient legislation and corruption, it is most prevalent in third world countries. Residents of these countries decide to sell organs because of financial problems. This thesis defines and analyses trafficking of human organs, tissues and cells at the global level using the method of analysis of factors of criminal strategy. The analysis of factors of criminal strategy for trafficking in human organs, tissues and cells is carried out for the United Kingdom of Great Britain and Northern Ireland, the Republic of India and the People's Republic of China. In the global market of human biological materials, citizens of the Republic of India and the People’s Republic of China are mostly victims, while citizens of the United Kingdom of Great Britain and Northern Ireland are customers traveling to third world countries for organ transplantation. In the United Kingdom of Great Britain and Northern Ireland, organ transplantation is appropriately regulated and controlled by several agencies. In the Republic of India, the control is improving; however, it is restricted due to corruption. In the People’s Republic of China, this field is not properly regulated, since public authorities are engaged in the trade of human organs, tissues and cells and travel for illegal organ transplantation.
