Abstract

Eno izmed najhujših kršitev človekovih pravic v današnjem času predstavlja trgovina z ljudmi, ki prizadene dostojanstvo in osebno integriteto na milijone ljudi po svetu, odvzeta jim je svoboda odločanja o lastnem življenju, podvrženi so najrazličnejšim oblikam izkoriščanja in prisile, obsojeni na vsakodnevno življenje v strahu pred grožnjami in nasiljem. Le redkim izmed njih je nudena pomoč. Številne žrtve niso nikoli odkrite, njihovi izkoriščevalci pa le redko obsojeni. Visoki dobički, ki jih omogoča, zagotavljajo, da jo najdemo povsod po svetu. V diplomski nalogi je v celoti predstavljena trgovina z ljudmi in njene različne pojavne oblike, najpogostejše žrtve, raznolikost storilcev, vključno z organiziranim kriminalom ter številni vzroki in dejavniki, ki jo omogočajo. Raziskana je razširjenost trgovine z ljudmi v Sloveniji, EU in svetu. Opredeljena je vloga Organizacije Združenih narodov, Sveta Evrope, Evropske unije in drugih mednarodnih (nevladnih) organizacij na področju boja proti trgovini z ljudmi. Na primeru Slovenije pa je predstavljen vpliv, ki ga imajo različni ratificirani mednarodni dokumenti in konvencije, na oblikovanje strategije in politiko boja proti trgovini z ljudmi pri nas. Ugotovili smo, da se kljub obsežnim prizadevanjem mednarodne skupnosti obseg trgovine z ljudmi ne zmanjšuje in da je potrebno še tesnejše mednarodno sodelovanje in usposabljanje na področju preventive ter odkrivanja, preiskovanja in pregona vseh oblik trgovine z ljudmi, saj dosedanji ukrepi, ne dajejo zadovoljivega rezultata. Hkrati pa moramo stremeti, k temu, da bosta vsem žrtvam nediskriminatorno nudena pomoč in zaščita. Da bi dosegli napredek v boju proti trgovini z ljudmi pa je potrebno vlagati v empirične raziskave tega pojava, saj nam le tako pridobljeni podatki, omogočajo oblikovanje strategij in politik, ki bodo imele dejanski učinek. Potrebno pa je tudi dodatno izobraževanje in ozaveščanje vseh javnosti tako na področju preventive kot tudi na področju preiskovanja in pregona teh kaznivih dejanj.

Secondary abstract: One of the most severe human right's violations of our time represents human trafficking. It damages human dignity and personal integrity of millions of people around the world. The feedom of making decisions about their own lifes is taken away from them, they are subjected to various forms of exploitation and force, convicted to the every day life in fear from threats and violence. Only few of them are given help. Many victims are never discovered, their exploiters rarely convicted. High profits, which it enables, assure, we can find it in every corner of the world. This thesis presents human trafficking in it's entirety, including all it's forms, common victims, diversity of perpetrators, including organised crime and it's many causes and factors, which are making it possible. Range of human trafficking in Slovenia, EU and the world is analysed. The role of United nations, Council of Europe, European Union and other international (non - governmental) organisations acting in this field is defined. The influence that many different ratified international documents, treaties and conventions have on the developement of the strategy and policy in the fight against human trafficking is shown on the case of Slovenia. We have ascertained that the human trafficking is not dimminishing despite the extensive efforts made by the international community and that more intensive international cooperation and qualifications in the field of prevention, investigation and prosecution of all forms of human trafficking is needed, because the existing measures have so far not given satisfactory results. We must aim to provide help and protection to all victims of this crime, without discrimination. In order to achive progress in the fight against human trafficking, we must invest in the empirical research of this crime, which is the only way to obtain reliable data for the developement of effective strategies and policies in the fight against human trafficking. The aditional education and informing of the general and professional public in the field of prevention, investigation and prosecution is needed.
