Abstract
Izbrana tema je v sklopu spolnih deliktov, kateri so poleg krvnih deliktov, najhujša oblika kaznivih dejanj. Kot tudi pri krvnih deliktih seže pojav spolnega napada ne le v fizično prizadetost, temveč tudi v psiho posameznika. Pri žrtvah so možne hude posledice, ki so lahko tudi dolgotrajne. Večina žrtev je ženskega spola, kar je dejstvo. Izvedenih je bilo veliko raziskav z žrtvami spolnih kaznivih dejanj. Žrtev je najprej v šoku in dezorientirana, sledi strah, občutki sramu in krivde. Znano je tudi, da se veliko število spolnih kaznivih dejanj sploh ne prijavi. Številnim žrtvam se ne zdi pomembna prijava kaznivega dejanja, nasploh jim predstavlja le nadaljnje breme. Med prijavami spolnih kaznivih dejanj se izkaže zelo majhen odstotek lažnih prijav. Do dejstva smo prišli preko izvedenega intervjuja z višjim kriminalističnim inšpektorjem. Tako smo prvo hipotezo, v kateri smo trdili nasprotno, lahko ovrgli. Verodostojnost žrtev spolnega napada je v večini primerov najbolj odvisna od psihofizičnega stanja žrtve. Trditev smo lahko preverili in sprejeli preko druge hipoteze. Spet nam je bil v pomoč izveden intervju. Obstajajo tudi drugi dejavniki, ki lahko vplivajo na verodostojnost izjave, kot na primer pozornost, nivo procesiranja ali spominske napake. Preverjanje verodostojnosti je privedlo do različnih tehnik in metod, vendar večina metod temelji le na osnovi ugotovitev raziskav, ki nimajo prave znanstvene veljave. Najbolj znana tehnika za preverjanje verodostojnosti izjav je Kriterijska vsebinska analiza. Ugotovili smo tudi, da se analiza uporablja le v nekaterih državah in da pri nas še nima dokazne veljave.

The chosen theme is a part of Sexual offenses, which are in addition to Blood offenses, the worse kind of crime. As well as by Blood offenses reaches the phenomenon of sexual assult not only in psysical disability, but also in the psyche of the individual. Victims suffer serious consequences, which can also be long-term. Most of the victims are women, which is a fact. A lot of research were made with sexual abused victims. A victim is firstly in shock and disoriented, followed by fear, fellings of shame and guilty. It is also known that a large number of Sexual offenses does not register. For many victims it does't seem important to register the Criminal offense, it represents just another burden. During all declarations of Sexual offenses are very small percentage of false declarations. To the fact we came through the interview with a higher criminal police investigator. In the first hypothesis we confirmed the opposte, so we dispoved it. The credibility of a victim of Sexual assault in most cases depends on the psycho-physical the state of the victim. This claim can be accepted through the secon hypothesis. Again, the interview was very helpful. There are also others facts that may affect the credibility of statement, like attention, the level of processing and memory errors. The checks of the credibility had led to different techniques and methods, but most of the methods only based on basis researchs and have no real scientific validity. The most well-known technique for credibility of statements is The cost corent analysis. The analysis are only used in some countries. In our country it has no probative force. |
