Abstract
Čezatlantsko trgovinsko in naložbeno partnerstvo (TTIP) spada v skupino megaregionalnih sporazumov. Njegov cilj je predvsem odprava trgovinskih ovir v različnih gospodarskih sektorjih, s čimer naj bi se olajšala nakup in prodaja blaga med Evropsko unijo in Združenimi državami Amerike. Gre za vsebinsko izredno širok sporazum, ki poteka med dvema velikima in ekonomsko močnima, a zelo različnima tvorbama, od katerih je ena nadnacionalna in druga nacionalna, vsaka od njiju pa uživa različno stopnjo varstva na področju varovanja družbe, okolja, javnega zdravja ter zaščite potrošnikov. Prav zaradi tega je pomembno, da se vsa odprta vprašanja, ki izhajajo iz sporazuma, dorečejo dosledno, eksaktno in transparentno. Pogajanja o sporazumu TTIP namreč potekajo v tajnosti , vsebina sporazuma se še vedno spreminja in razvija, nekatere države članice Evropske unije (v nadaljevanju EU) pa podpisu sporazuma odkrito nasprotujejo. Eno najspornejših vprašanj iz sporazuma je prav gotovo vprašanje vključitve mehanizma za reševanje sporov Invesor- State Dispute Settlement (v nadaljevanju ISDS) oziroma Investment Court System (v nadaljevanju ICS) v sporazum.
Magistrsko delo obravnava pojem TTIP na splošno, torej njegove bistvene lastnosti ter v zvezi s tem tako predvidene prednosti in morebitne slabosti. V posebnem delu pa se dotakne reševanja mednarodnih investicijskih sporov in pri tem podrobno obravnava mehanizem za reševanje sporov med investitorji in državami ter zaščito tujih investicij v sporazumu TTIP. Primerjalnopravni pregled mehanizma ISDS in predlaganega izboljšanega mehanizma ICS pokaže veliko negotovost zaupanja v tovrstne mehanizme in odpira vprašanje nujnosti vključitve takega mehanizma v megaregionalne sporazume tako TTIP kot primerljive sporazume.

The Transatlantic Trade and Investment Partnership (TTIP) belongs to the group of mega-regional agreements. Its aim, in particular, is to remove trade barriers in different business sectors in order to facilitate the purchase and sale of goods between the European Union and the United States of America. Contentwise, it is an extremely wide agreement between two big and economically strong, yet very diverse formations, of which one is transnational and the other one national, wherein each of them enjoys a different level of protection in terms of protection of society, the environment, public health and consumers. For this reason, it is important to discuss all open issues resulting from the agreement in a coherent, accurate and transparent way. Negotiations on the TTIP agreement are conducted in secrecy, the content of the agreement is still changing and evolving, and some EU Member States openly oppose the signing of the agreement. One of the most controversial issues of the agreement is certainly the question of including an Investor – State Dispute Settlement (ISDS) / Investment Court System (ICS) dispute settlement mechanism in the agreement.
This master’s thesis deals with the TTIP term in general, i.e. its essential characteristics and the related envisaged advantages as well as possible disadvantages. A special section addresses the settlement of international investment disputes, and also includes an in-depth discussion of the investor-state dispute settlement mechanism and the protection of foreign investment in the TTIP agreement. A comparative legal overview of the ISDS mechanism and the proposed improved ICS mechanism shows considerable uncertainty about trusting such mechanism, and raises the question of the need to include this mechanism into such mega-regional agreements, both the TTIP and comparable agreements. |
