Abstract

V diplomskem delu obravnavamo prisotnost, pomembnost in značilnosti zasebnih zaporov v ZDA, ki so posledica turbulentnega zgodovinskega in sodobnega dogajanja na družbeno-socialnem, političnem in ustavnem področju. Prve inštitucije, ki bi jih lahko imenovali zapor, so se v Evropi pojavile v 16. stoletju, in so bile preprosto organizirane, slabo varovane in v veliki meri namenjene odrivu revnega prebivalstva od ostale družbe. Tekom stoletji pa je kazensko-pravosodni sistem doživel velike preobrate, dobil ogromno novih določil, zakonov ter raznovrstnih organizacij, kar ga je razvilo v ogromen konglomerat zahtevnih sistemov, osebja in predvsem nadvse visokih števil, ko govorimo o stroških. Napoved “vojne proti drogam” ni zmanjšala števila kaznivih dejanj in kriminalitete, ampak povzročila ravno nasprotno - začela množično inkarceracijo, ki jo ZDA in svet še nista poznala. Ravno množična inkarceracija v prejšnjem stoletju je bila razlog za ustanovitev zasebnih zaporov. Posebno pozornost namenjamo raziskavi razvoja penalnih inštitucij in kazenske zakonodaje, saj je brez oziranja v zgodovino nemogoče razumeti, kako in zakaj so se zasebni zapori razvili tako hitro in v tako neverjetno velikem obsegu. Zanima nas tudi primerjava privatnih zaporov ZDA, z javnimi (zveznimi in državnimi), saj so vendar del istega sistema in tako ves čas sovplivajo na njegov razvoj. Zanima nas delovanje zasebnih zaporov, njihova profitabilnost ter delo zasebnih podjetij, ki upravljajo zasebne zaporne inštitucije. Nenazadnje pa je analiza namenjena predstavitvi vpliva zasebnih korporacij na penalni sistem, človekove pravice, zakonodajo in politiko ZDA.

Secondary title: Private prisons: A case study of the U.S. prison system
Secondary abstract: In this degree research we are talking about presence, importance and characteristics of private prisons in USA, which are result of turbulent prison history as well as modern social, political and constitutional developments. Institutions called prisons, first opened in Europe in 16th century. In that time, they have had basic organization, low security and their function has been to dislocate poor population from the rest of the society. In next centuries prison-judicial system has seen great changes, got many new laws, along with new regulations and agencies. All of the above, developed this system into massive conglomerate of demanding systems, personnel and most important, high budget costs. Declaration of “war on drugs” did not reduce the number of committed crimes but it started massive incarceration that USA and whole world did not see till then. The mass incarceration of 20th century was the reason for the creation of private prisons in modern society. We will devoted special attention to research of the development of the prison institutions and criminal legislation, because without knowing the history we can not understand why did the private prisons develope so fast and got so big. We are interested in comparing private prisons to public prisons (state and federal) in USA, because they are all part of the same punitive system and so they have great influence on the development of it. We are also interested in operation of private prisons, their profitability and action of the private companies that manage the private prisons. Last but not least, this analysis is devoted to presentation of influence of private companies on penal system, human rights, legislature and politics of the USA.
