Abstract

Informacijski pooblaščenec Republike Slovenije je samostojen in neodvisen državni organ, ustanovljen z Zakonom o Informacijskem pooblaščencu, ki ga je Državni zbor sprejel na seji 30. novembra 2005. Inšpektorat za varstvo podatkov in dostopa do informacij Republike Estonije pa je nadzorni organ, ki deluje pod okriljem Ministrstva za pravosodje. V okviru svojih pristojnosti oba organa delujeta na področju varstva osebnih podatkov in na področju dostopa do informacij javnega značaja. Z odprtostjo informacij na eni strani ter nadzorom in varstvom zasebnosti na drugi strani Informacijski pooblaščenec stremi k učinkovitemu uresničevanju dveh temeljnih človekovih pravic, ki sta zagotovljeni že z ustavo. Izsledki naše raziskave/analize kažejo, da se število pritožb, prekrškov itd. v Sloveniji še vedno iz leta v leto povečuje in da je njihovo število v Sloveniji bistveno večje kot v Estoniji. Izboljšala se je predvsem ozaveščenost in poznavanje obeh področij. Na drugi strani pa je zaskrbljujoče dejstvo, da postaja obvladovanje želja po obdelavi osebnih podatkov vse težje. Zaradi vse hitrejšega razvoja tehnologije se namreč pojavlja napačno interpretiranje pravice do zasebnosti. Urad informacijskega pooblaščenca povečanje vidi kot negativni kazalnik, ki kaže na manjšo oziroma nezadostno odzivnost organov na prvi stopnji.

Secondary abstract: Information commissioner of Republic of Slovenia is independent and independent state body, founded with law on the information commissioner that the National Assembly accepted at session on November 30, 2005. Inspectorate for data protection and accesses towards information of the republic of Estonia is supervisory body that works under aegis of the Ministry of Justice. Both bodies work to information of public character in frame of their competences on field of protection of personal data and on field access. The information commissioner aspires for efficient implementation of two basic human rights that are ensured already with constitution, with openness of information on one page and control and protection of privacy on opposite direction. Findings of our research per analyses are indicating, that number of complaints, offences etc. is increasing in Slovenia still from year on year and that their number in Slovenia is larger elementarily as in Estonia. Above all awareness picked up and knowledge of both fields. On the other hand is disturbing fact, that containment is becoming wish of treatment of personal data increasingly more heavily. Wrong interpreting of right to privacy namely is appearing because of increasingly quicker development of technology. Office of information commissioner sees extension as negative indicator that is pointing smaller and insufficient reactivity of bodies on first rate out.
