Abstract

Secondary title: Instuments for execution of the judgements of the administrative court
Secondary abstract: In the thesis the Author deals with the mechanisms that are necessary to assure the execution of the judgements of the Administrative Court by administrative authorities. In the beginning the Author establishes the relationship between Administrative Court and administrative authorities in Slovenia. Next, the Author deals with the duty of the administrative authorities to respect the legal opinions of Administrative Court set forth in the judgements of the latter, as regulated de lege lata. In this respect, the Author focuses on the judgements of Administrative Court by which the court annuls the administrative act and refers the matter back to the administrative authority to adopt new decision. Furthermore, the Author describes the mechanisms for the execution of the Administrative Courts` judgements in different legal systems, namely Belgium, Croatia and Italy. With regards to the latter the Author also describes whether the instruments for execution of Administrative Courts` decisions of each respective country could be transferred in Slovenian legal system with respect to relationship between Slovenian Administrative Court and Slovenian administrative authorities. Finally, the Author tackles the question of the regulation of instruments for the execution of the decisions of the Administrative Court de lege ferenda by introducing the solution that would ensure the most effective execution of the judgements of Administrative Court in Slovenian legal system.
