Primerjalnopravno vrednotenje ženskega vprašanja v antiki (Grčija-Rimska država)

Abstract

Za jasnejšo predstavo o položaju in situaciji žensk v antiki sem se osredotočila na primerjavo družbene situacije v stari Grčiji in rimski državi, saj ti dve civilizaciji predstavljata začetke formiranja držav in demokracije in s tem posledično državljanstva, političnih pravic in kultivirane družbe kot jo poznamo danes. Družbeno stanje takratnega časa in takratni aktualni dogodki, ki pričajo o situiranosti žensk, so podkrepljeni in dokumentirani s pisnimi viri, kar omogoča lažje raziskovanje. Takratnemu času je bila primerna tudi pravna terminologija, ki sem jo poskušala obrazložiti tako za antično Grčijo kot za rimsko državo. Nekateri pravni termini so se nanašali na enako problematiko tako v Grčiji kot v Rimu, definicija nekaterih istih terminov pa se je v obeh državah razlikovala. Analitični del diplomske naloge sem opravila s pomočjo pravnozgodovinske in primerjalnopravne raziskovalne metode in s pomočjo deskripcije poskušala odgovoriti na vprašanje žensk v politiki, samostojnosti, odnosu do lastnine, njihovem statusu znotraj zakonske zveze in znotraj pravne varnosti. Na podlagi slednjih sem ugotovila, da o zgodovinskem ženskem vprašanju v antični Grčiji in rimski državi ne moremo razpravljati, saj se je sam pojem ženskega vprašanja začel razvijati šele v času francoske revolucije.

Secondary abstract:	In order to make the idea about the women's position and situation in the ancient times more clear I focused on the comparison of the social situation of ancient Greece and that of Rome. These civilizations represent the beginnings of the formation of countries and consequently citizenship, political rights, and the civilized society in which we live today. The social condition of the ancient times and then current happenings testify about the situation of women. They are corroborated and documented with written sources which enable easier researching. The terminology in the field of law coincided with the ancient times. I tried to research and explain the terminology used in ancient Greece as well as the one used in ancient Rome. Some legal terms covered the same problematic situations in ancient Greece and in ancient Rome. However, some definitions of the same legal terms differ in those countries and cover different problems. The analytical part of the thesis was completed by using the comparative, historical, and descriptive research method. On the basis of the aforementioned methods I concluded that we cannot discuss the woman question in ancient Greece and ancient Rome, since the very term “woman question” started forming in the time of the French revolution.
