Abstract

Zakoniti zastopnik je posebej strokovno usposobljena oseba, ki zastopa mladoletnika brez spremstva v postopku za priznanje mednarodne zaščite, sodeluje v postopku in skrbi za zagotavljanje otrokovih največjih koristi. Mladoletnik brez spremstva je oseba, mlajša od 18 let, ki se nahaja na ozemlju Republike Slovenije brez staršev ali zakonitih zastopnikov. Zakoniti zastopnik je osebi dodeljen vedno, ko se ta izreče za mladoletno, pri čemer pristojni organ pri njegovi postavitvi ne upošteva otrokovega mnenja. V postopku sme samostojno predlagati določene dokaze, ne sme pa podajati izjav. Sodeluje pri določanju prosilčeve starosti, če je ta sporna. V Republiki Sloveniji za zagotavljanje zakonitih zastopnikov v največji meri skrbi Slovenska filantropija. Zakonito zastopanje preneha s polnoletnostjo oziroma z izvršitvijo odločbe o priznanju mednarodne zaščite.

Secondary title: Legal guardianship of unaccompanied minors in Slovenian asylum procedure
Secondary abstract: Legal guardian is a specially qualified person who represents an unaccompanied minor in asylum procedure, takes an active part in the procedure and ensures the best interests of a child. Unaccompanied minor is a person below the age of 18 years who is found on the territory of Republic of Slovenia without their parents or legal guardians. Legal guardian is appointed whenever the person affirms they are under age but without their cooperation. Legal guardian can provide evidence during the asylum procedure but they can not make their own statements. They take part in determining child’s age if such determination is required. In Republic of Slovenia most legal guardians are a part of non-governmental organisation Slovenian philanthropy. Legal guardianship ends when the asylum seeker comes of age or when the final decision about their application is executed.
