Abstract

V delu je opisan pomen avtonomije pacienta glede medicinskih posegov in zdravstvene oskrbe. Praviloma ni dovoljeno opraviti medicinskega posega brez soglasja pacienta. Da pa se bo pacient lahko pravilno odločil, mora zdravnik najprej opraviti pojasnilno dolžnost. Kadar gre za osebe, ki niso spoosobne odločanja o sebi, bodo takšno privolitev dali njihovi zakoniti zastopniki. Pacient lahko poda tudi vnaprejšnjo izjavo volje za primere, ko ne bo sposoben odločati sam o sebi. Na koncu je predstavljena tudi odgovornost zdravnika za zdravstvene ukrepe brez privolitve. V teorijo so vpeti tudi primeri iz domače in tuje sodne prakse.

Secondary title: INFORMED CONSENT WHEN THE PATIENT IS UNABLE TO CO-OPERATE
Secondary abstract: The work describes the role of the self-determination of the patient regarding medical treatment and nursing care. As a rule, it is not allowed to perform a medical treatment or nursing care without the patient’s consent. But that the patient can make the right decision, the doctor should first give to the patient informed consent. On the basis of information the patient decide whether to grant or refuse such interference. In the case of persons who are unable to co-operate, such consent is given by their legal representatives. The patient can also form the anticipated will for the case, when he/she won't be able to make their own decisions. And finally, it is presented the doctor's responsibility for treatment without informed consent. Through work there are also presented cases from domestic and foreign court decisions.
