Abstract
Republika Slovenija je z osamosvojitvijo ter vstopom v mednarodne institucije nase prevzela tudi obveznost, da bo svojo zakonodajo prilagodila ureditvi, ki izhaja iz mednarodnopravnih aktov. V pričujočem diplomskem delu sem skušala na kratko prikazati uspešnost ali neuspešnost izpolnjevanja omenjene obveznosti s strani Republike Slovenije in oceniti skladnost slovenskega (kazenskega) prava z izbranimi mednarodnimi inkriminacijami, uzakonjenimi v različnih univerzalnih in regionalnih mednarodnopravnih dokumetih.
Uvodoma vzpostavljam povezavo med mednarodnim pravom, mednarodnim varstvom človekovih pravic, kazensko odgovornostjo posameznika in notranjim pravom posameznih držav z namenom bralca seznaniti z nekaterimi pomembnimi dosežki sodobnega mednarodnega (kazenskega) prava.
Diplomsko delo je vsebinsko razdeljeno na dva dela.
V prvem delu opredeljujem teoretično problematičen pojem mednarodnih hudodelstev in mednarodnih zločinov ter njihovo še vedno nedorečeno delitev. Nadalje zaradi razumevanja implementacije mednarodnopravnih pravil v nacionalne zakonodajne sisteme obravnavam razmerje tako med mednarodnim in nacionalnim pravom kot med nacionalnim in mednarodnim kazenskim pravom, saj je eden izmed temeljnih problemov pri slednjem kot posebni pravni disciplini v nastajanju vprašanje, ali in kako se norme mednarodnega kazenskega prava uveljavljajo v domačem pravu in v pravni praksi držav članic globalne ali regionalnih mednarodnih skupnosti. Mednje sodi tudi Republika Slovenija.
V drugem delu obravnavam šest izbranih mednarodnih hudodelstev in mednarodnih zločinov (genocid, mučenje in sorodna ravnanja, nezakonit promet z mamili in psihotropnimi substancami, ogrožanje mednarodne varnosti zračnega prometa, pranje denarja in ogrožanje okolja) z vidika njihove prepovedi v pomembnejših univerzalnih in regionalnih mednarodnopravnih aktih. Ob koncu vsakega podpoglavja pa kot najpomembnejše analiziram in primerjam vsebino inkriminacij v slovenskem pravnem redu (predvsem v novem Kazenskem zakoniku (KZ-1)) in ugotavljam njihovo skladnost s prej omenjenimi mednarodnimi inkriminacijami.

THE IMPLEMENTATION OF SELECTED INTERNATIONAL CRIMINAL OFFENCES WITHIN SLOVENIAN NATIONAL LEGAL SYSTEM |

When Republic of Slovenia became an independent state, a member of several international organizations and documents, it has also become obliged to adapt its national legal system to international law. The main purpose of this discussion is to conclude, whether Republic of Slovenia has complied its international obligations and whether the legal regulation of the Panel Code of the Republic of Slovenia is in accordance with the regulation of international criminal law, regarding criminalization of selected international criminal offences.
Initially I am trying to establish a link between international law, international protection of human rights, criminal responsibility of individuals and national legal systems of states to point out some major achievements of modern international criminal law.
Thesis problem is substantially divided into two parts.
The first part is intended to define a theoretically problematic concept of international offences and its indefinite partition. Moreover, it is also intended to show relations between national and specially international criminal law, where the main question is: if and how can norms of international criminal law be enforced into national criminal law.
For purposes of analysis the compatibility of Slovenian legal system with international criminal law, the second part systematically presents relevant norms of individual international acts, which incriminate selected international offences: genocide, torture and related conducts, illicit traffic in narcotic drugs and psychotropic substances, criminal offences against international civil aviation, money laundering and criminal offences against environment. The comparison of mentioned international norms to criminalization in Slovenian Penal Code shows the level of harmonization of Slovenian criminal law with the criminalization of international law. |
