Vloga mediatorja v družinskopravnih sporih

Abstract

V času velikih sodnih zaostankov postajajo alternativne oblike reševanja sporov vedno aktualnejše. V ospredju prevladuje mediacija, katere bistvo je v dogovoru sporazumne rešitve med strankama, katero so ljudje običajno pripravljeni bolj spoštovati kot pa avtoritativno odločitev sodišča. Diplomsko delo obsega področje družinske mediacije. Prvi del je namenjen predstavitvi mediacije s poudarkom na družinskih zadevah. Opisane so njene temeljne značilnosti, načela ter sam potek mediacijskega postopka. Osrednji namen naloge je predstaviti vlogo mediatorja v družinskopravnih sporih. Temu sledi analiza dejstev, ki se nanašajo na ugotovitev, da je mediator pomemben dejavnik v postopku mediacije, kljub temu da sam nima nikakršne moči avtoritativno poseči v razmerje med strankam. S pomočjo grafov je ob koncu podan še prikaz uspešnosti mediacijskih postopkov v družinskopravnih sporih med letom 2002 in 2008. Prav tako je prikazana tudi primerjava uspešnosti mediacijskih postopkov v pravdnih, družinskih in gospodarskih sporih.

Secondary abstract:	In the time of great judicial backlog alternative forms of dispute resolutions are becoming more and more popular. Most common form of these is mediation, which main purpose is agreeable solution between clients and is usually more respected than the authoritative decision made by the court. The diploma thesis consists of the area of family mediation. The first part is focused on presentation of mediation with the highlight on family matters. Main characteristics, principles and the course of the mediation procedure itself are being described. The main purpose of the diploma thesis is to present the role of the mediator in the family disputes. This is followed by an analysis of the facts, which are referring to a statement, that the mediator is an important factor in the procedure of the mediation, even if he by himself has no power of authoritarian intervention in relations between clients. With the help of charts, the display of the success of the mediation procedures between years 2002 and 2008 is shown at the end. The comparison between the success of the mediation procedures in the judicial, family and economic disputes is also being shown.
