Abstract

Pričujoča diplomska naloga obravnava vprašanje, ali Svetovna trgovinska organizacija (STO) poleg svojih primarnih nalog omogoča tudi varstvo okolja. STO je namenjena liberalizaciji svetovne trgovine, zaradi česar so v vsem tem dolgem času obstoja bili sprejeti številni sporazumi in drugi akti. Nobeden od njih ni bil namensko sprejet zaradi varstva okolja, vendar določeni vsebujejo t.i. zelene klavzule. Najpomembnejšo zeleno določbo, kadar pride do konflikta med varstvom okolja in prosto trgovino, vsebuje Splošni sporazum o carinah in trgovini (GATT) iz leta 1947, ki je predhodnik današnje STO. XX. člen tega sporazuma vsebuje splošne izjeme, ki jih je mogoče uporabiti, kadar želi članica STO opravičiti ukrep, ki je neskladen s pravnim redom STO. Opazimo lahko, da z leti varstvo okolja postaja vedno pomembnejše in temu trendu sledi tudi STO. Pogajanja na tem področju so vedno intenzivnejša, poleg tega pa se poskuša pospešiti liberalizacijo okoljskih storitev in blaga. Tudi reševanje okoljskih sporov danes vedno bolj poteka v luči varstva okolja, ki je postalo pomembnejše kot svetovna trgovina brez omejitev.

Secondary title: ENVIRONMENT PROTECTION IN THE WORLD TRADE ORGANISATION
Secondary abstract: The present thesis deals with the question of whether the World Trade Organization (WTO) can, along with their primary tasks, also protect the environment. The WTO is aimed to liberalize world trading, and, therefore, a number of agreements and other acts had been adopted. Although none of them were deliberately adopted to protect the environment, some contain the so called green clauses. When there is a conflict between environmental protection and free trade, the General Agreement on Tariffs and Trade (GATT) from 1947, the predecessor of today's WTO, includes the most important green regulation. XX article of the Agreement includes general exceptions, which can be used when a WTO member wishes to justify a measure inconsistent with WTO law. We can notice that over the years, environmental protection is becoming increasingly important and this trend is followed also by the WTO. Not only are negotiations in this area more and more intense, but also the liberalization of environmental goods and services is among the tasks to be promoted. Furthermore, dealing with environmental conflicts today is growing to be the task of environmental protection, which has already become more important than the world trade without restrictions.
