Abstract

Pravica do svobode izražanja je ena temeljnih človekovih pravic in svoboščin, ki zajema svobodo misli, sprejemanje in oddajanje mnenj in idej ter svobodo medijev. Hkrati je tudi temelj za učinkovito izvrševanje mnogih drugih človekovih pravic. Prav zaradi izrednega pomena, ki ga ima ta pravica, so tudi obveznosti države pri njenem zagotavljanju precej obširne. Pravica do svobode izražanja sme biti omejena, kadar za to obstajajo utemeljeni razlogi. To se zgodi zlasti takrat, ko se pravico do svobode izražanja izvršuje tako, da se z njo posega v pravico do zasebnosti ali pravico do časti in dobrega imena drugih subjektov oziroma tako, da se jo zlorablja in izvršuje v obliki sovražnega govora. Presojanje, do kje sega pravica do svobode izražanja in ali je bila ta pravica upravičeno omejena, je ena zahtevnejših nalog nacionalnih sodišč in Evropskega sodišča za človekove pravice iz Strasbourga. Pravica do svobode izražanja namreč ne sme biti omejena zgolj zato, ker so izražena mnenja ali ideje za širšo javnost nesprejemljive ali celo žaljive, temveč le takrat, kadar je to res nujno zaradi zaščite javnosti oziroma prizadetega posameznika.

Secondary abstract: Freedom of expression is one of the most fundamental human rights and freedoms, which contains freedom of thoughts, freedom of accepting and giving opinions and ideas and also freedom of media. Freedom of expression is a foundation for many other human rights and their efficient practising. Because of its importance, countries are obligated to assure and secure freedom of expression. Freedom of expression can be limited, when different conditions are fulfilled. This often happens, when freedom of expression is carried out in a way, which interferes with the right to privacy, right to personal integrity or can be characterized as hate speech. To judge, to where the freedom of expression actually extends to and if its limitations were justified, is one of the most complicated assignments of nacional courts and of European court of human rights in Strasbourg. Freedom of expression must not be limited only because the ideas and opinions are not acceptable or are insulting for general public, but only when this is really urgent for protecting the public or affected individual.
