od ODZ-ja do OZ-ja
Abstract
Odškodninska odgovornost je lahko bodisi pogodbena bodisi nepogodbena. Pogodbena odškodninska odgovornost je odgovornost za škodo, ki nastane zato, ker kdo prekrši kakšno pogodbeno obveznost, nepogodbena odškodninska odgovornost pa je odgovornost za škodo, ki nastane zato, ker nekdo poseže v tujo korist, ne da bi bil z oškodovancem v kakšni poslovni zvezi. Občni državljanski zakonik (ODZ) je urejal omenjeni vrsti odškodninske odgovornosti enotno v generalni klavzuli, kasnejši Zakon o obligacijskih razmerjih (ZOR) pa ju je uredil v ločenih poglavjih. Kljub temu pa je še naprej prevladalo stališče, da sta pogodbena in nepogodbena odškodninska odgovornost urejeni enotno in predstavljata enotno institucijo, saj se v glavnem za povrnitev škode, povzročene s kršitvijo pogodbene obveznosti, še naprej uporabljajo načela nepogodbene odškodninske odgovornosti z določenimi posebnostmi, ki veljajo za pogodbeno odškodninsko odgovornost. Glede na to, da je vsebina odškodninske odgovornosti v Obligacijskem zakoniku (OZ) prevzeta iz ZOR-a, imata pogodbena in nepogodbena odškodninska odgovornost tudi v OZ-ju enotni pravni naslov. V diplomskem delu na začetku predstavljam osnovne značilnosti analiziranih virov (ODZ, ZOR in OZ), v nadaljevanju pa se osredotočam na način urejanja pogodbene in nepogodbene odškodninske odgovornosti ter na njuna temeljna vsebinska vprašanja (to so vrste odgovornosti, oprostitev odgovornosti, omejitev in izključitev odgovornosti ter razširitev odgovornosti) v obravnavanih virih.

Liability may be either contractual or non-contractual. Contractual liability is liability for damage caused if a person breaches any obligation under a contract; non-contractual liability, on the other hand, arises out of damage caused to another, whereby no legal connection exists with the one who has suffered damage. Initially, the above types of liability were regulated uniformly by a general clause in the General Civil Code ('GCC), whereas in the subsequent Obligations Act (‘OA’) they were indicated under two separate chapters. Nevertheless, a view continued to prevail that contractual and non-contractual liabilities were regulated uniformly and that they represented a single institution given that for compensation for damage caused by breaching a contractual obligation the principles of non-contractual liability continue to apply in the light of certain characteristics specific to contractual liability. Since the content of liability in the Code of Obligations (‘CO’) is taken from the Obligations Act, contractual and non-contractual liabilities also have a single legal title in the Code of Obligations. I indicate in my diploma paper the key characteristics of the sources analysed (GCC, OA and CO) and then I focus on rules on contractual and non-contractual liability as well as their key substantive aspects (i.e. types of liability, exemption from liability, limitation and exclusion of liability and extension of liability) in the sources concerned. |
