Abstract
Narava zdravniškega dela je taka, da se zdravniki pogosto znajdejo v situaciji, kjer so sekunde odločilnega pomena in mora biti reakcija ukrepanja hitra, učinkovita, zdravljenje pa kakovostno, z največjo mero znanja, usposobljenosti, etičnosti in znanstvenosti. Naloga pravne in medicinske veje je zavarovanje in zaščita zdravja posameznika. Ko se navedeni panogi križata, pride do stičišča med medicino in pravom. Prav zaradi stične točke morajo zdravniki pri svojem delu spoštovati zdravstveno zakonodajo, ki pacientu pripisuje pravice, pri tem pa svoje delo opraviti v skladu z dolžnostjo in profesionalnostjo. V primeru, ko pride do nasprotij in neskladij pri zdravljenju, vstopi v ospredje institut kazenske in ali civilne odgovornosti zdravnika, ki poskuša »zabrisati« nastalo škodo, vendar pa nobena zakonodaja ne more izsiliti poklicne predanosti, plemenitosti, osebnih lastnosti in humanosti zdravnikov pri svojem delu. V začetnem delu magistrskega dela bom pregledal pomembnejšo slovensko in mednarodno zdravstveno zakonodajo iz katere se črpajo pravice in dolžnosti pacienta na eni in pravice in dolžnosti zdravnika na drugi strani. Nato bom podrobneje predstavil zdravstvene institute, kot so ugovor vesti, obrezovanje moških, evtanazija, umetna prekinitev nosečnosti ter posledične poškodbe na zarodku, nedovoljene eksplantacije in kdaj v navedenih primerih nastopi kazenskopravna odgovornost zdravnikov. Nadalje bom preko medijsko razvpitega primera »Nekrep«, ki se vodi pred mariborskim Okrožnim sodiščem, ovekovečil malomarno zdravljenje zdravnika. Zaključek raziskovanja bom posvetil delu izvedencev medicinske stroke, ki so s svojimi mnenji sodiščem v pomoč pri presoji odškodninske ali kazenske odgovornosti v primeru, ko gre za zdravnika v vlogi (ob)toženca.

WHEN DOES MEDICAL TREATMENT BECOME A PENAL LEGAL REBUKE? |

The nature of physician's work is such that physicians often get into a situation when seconds are decisively important and the reaction to response must be quick, effective, the treatment must be of highest quality, with highest level of knowledge, qualification, ethics and scientific capacity. A task of legal and medical branch is to ensure and protect the individual's health. When these to branches cross medicine and jurisprudence come into contact. Especially because of such contacting point the physicians have to respect the medical legislation at their work as the patients are entitled to their rights and the physicians have to perform their work in accordance with responsibility and professionalism. In case of contradictions and discordances during treatment, the institute of physician's penal and/or civil responsibility come to the forefront and the physician tries »to obliterate« the inflicted damage, however, no legislation can exact the professional devotion, generosity, personal qualities and physician's humanity at work. In the introductory chapter of my M.Sc work, I am going to review a notable Slovene and international medical legislation defining the patient's rights and obligations on the one hand and the physician's rights and obligations on the other hand. After that, I am going to introduce the medical institutes in detail, such as objection of consience, circumcision of men, euthanasia, artificial discontinuance of pregnancy and consecutive damage on the embryo, prohibited explantation and when the physician's penal legal responsibility arisis in such cases. Futhermore, I am going to eternalize a negligent treatment by a physician in the Nekrep case brought into disrepute by mass media and being proceeded at the Maribor District Court. The research work will be concluded and devoted to the work of medical experts who take part by their expertise in the proceedings at the courts when judging the physician's indemnity or penal responsibility in a defendant's role. |
