Abstract

Namen diplomskega dela je na podlagi teoretičnega uvoda podrobneje predstaviti najbolj pogosta koruptivna ravnanja v javni upravi Republike Slovenije. Javna uprava predstavlja področje, kjer korupcija pusti največ negativnih posledic, saj zaradi nje bledi zaupanje v javne funkcije in s tem tudi zaupanje v pravno državo. Uslužbenci v javni upravi opravljajo pri svojem poklicu izvršne in upravne naloge v upravnem sistemu, pri katerih se morajo izogniti situacijam, ki bi vodile do izkoriščanja javnih funkcij ter do pristranskega opravljanja njihovih nalog. Po uvodnih pojasnilih korupcije, različnih oblik le-te, javne uprave, konflikta interesov sem na kratko predstavila tudi škodljivost teh pojavov ter njihov nastanek. Pri analizi razširjenosti korupcije v javni upravi sem se poslužila predvsem metodološke analize dostopne literature, predvsem primerov iz Načelnih mnenj Komisije za preprečevanje korupcije. Tako sem ugotovila, da je bilo največ korupcije zaznane na področju javnih naročanj, drugih razpisov ter pri postopkih razpolaganja z državnim premoženjem. S pričujočim delom želim podrobneje opisati pojem korupcije, kje v javni upravi jo je mogoče največ zaslediti, samo problematiko pojma, predvsem pa bralca spodbuditi k kritičnemu razmišljanju o vplivu korupcijskih ravnanj v javni upravi in vplivu le-teh na delovanje pravne države.

Secondary abstract: The purpose of this work is to analyse, on basis of theoretical introduction, to present in detail the most common corrupt practices in public administration of the Republic of Slovenia. Public administration is a field where corruption is left up to the negative consequences, since it makes the waning trust in public office and thus confidence in the rule of law. Public employees perform their work in the executive and administrative functions in the administrative system, which should avoid situations that could lead to exploitation of public office and to the discriminatory discharge of their duties. After introductory explanations of corruption, different forms of it, public administrations, conflict of interest, I have also presented the dangers of these phenomena and their origins. When analyzing the prevalence of corruption in public administration, I resorted to mainly methodological analysis of available literature, in particular cases of the broad views of the Commission for the Prevention of Corruption. I found that the most perceives corruption is in public procurement, tendering and other procedures to dispose of state property. With this work I describe in detail the concept of corruption in public administration, where it can be traced, the issue of the concept of corruption. In particular, to encourage the reader to critically think about the impact of corruption practices in public administration and the impact thereof on the rule of law.
