Abstract

Mala in srednja podjetja po svetu ter v Sloveniji predstavljajo veliko večino vseh podjetij in zaposlujejo najmanj polovico vse delovne sile. Obenem predstavljajo vir nove intelektualne lastnine, za zaščito katere pa se le redko odločajo. Pojem intelektualna lastnina povzema vse izdelke, ki so nastali kot rezultat človeškega intelekta in razmišljanja. Zaradi večje povezanosti s svetom, tudi zaradi interneta, je kontrola nad prikazanim in izrečenim vse težja, zato lažje prihaja do izkoriščanja nezaščitene ali kršenja že zaščitene intelektualne lastnine. Nezaščiten izum se lahko izgubi zaradi tekmecev, ki ne porabijo denarja in časa za njegov razvoj, s tem pa originalni izumitelj ostane brez nagrade ali zaslužka. Formalno zaščito intelektualne lastnine delimo na avtorske pravice in industrijsko lastnino, med katero spadajo patenti, modeli, znamke, geografske označbe in drugi varstveni certifikati. Informacije o zaščiti so dostopne pri različnih uradih, patentnih zastopnikih in bazah podatkov dostopnih na internetu. Prijavitelj se mora odločiti za način zaščite intelektualne lastnine glede na tip izuma/storitve, želeni obseg zaščite in področje zaščite. S tem si prilagodi stroške, ki so lahko relativno visoki za manjša podjetja. Podjetja, ki se odločajo za zaščito imajo prednost pred konkurenco, saj tako zaščitijo lastne produkte pred ponarejanjem oziroma trženjem izdelkov slabše kvalitete kot so originalni. S tem dajo tudi njihovim potrošnikov zaupanje v lastne produkte. Tako pridobljena prepoznavnost jim omogoča obstoj in razvoj, kot tudi prednost pred konkurenco. Omenjene koristi navajajo tudi anketirana podjetja. Na splošno število patentnih prijav, modelov in znamk narašča, tudi v Sloveniji, kar je dober znak razvoja ekonomsko-poslovnega področja. Vendar pa kljub trudu svetovne organizacije za intelektualno lastnino (WIPO) in drugih uradov na področju izobraževanja malih in srednjih podjetij o pomembnosti zaščite intelektualne lastnine, še vedno ni preskoka naprej. Morda tudi zato, ker so kljub optimizaciji stroškov zaščite pogosto le-ti še vedno previsoki. V ta namen bi bilo dobro razmisliti o možnosti prilagajanja stroškov pristojbin za zaščito intelektualne lastnine glede na velikost podjetja, ki jo prijavlja. Če bi imela vsa podjetja relativno enake stroške, bi bilo zagotavljanje lojalne konkurence lažje in varnost manjših podjetij večja. Slednje je cilj uradov za zaščito intelektualne lastnine po celem svetu.

Secondary title: Importance of intellectual property for small and medium-sized enterprises, possibilities of protection and its acquirement
Secondary abstract: Small and medium sized enterprises around the World and in Slovenia represent a majority of all enterprises. At the same time they employ at least a half of the working capacity. Furthermore, small and medium sized enterprises are an important source of new intellectual property, for protection of which they rarely decide. The term intellectual property sums up all products that have evolved as a result of human intellect and deliberation. Due to increased connectivity of the World it is getting harder to control what is shown to other enterprises or people. Therefore exploitation of unprotected or violation of protected intellectual property is becoming quite common. Unprotected invention can be lost due to competition which does not spend their time and money for its development, leading to no financial gains or reward for the original inventor. Formal protection of intellectual property can be divided into two fields, copyright and industrial property, among which patents, models, trademarks, geographic designation and other certificates can be found. Information about the protection can be acquired at different bureaus, patent attorneys and databases on the internet. Inventor or an enterprise representative must decide for the type of protection that is needed for a particular invention/service, desired extent of protection as well as the geographical area of protection. Such consideration can lead to optimization of costs for protection, which can be rather high. Enterprises that protect their intellectual property have a significant advantage against their competition, as their products are protected against imitation and marketing of less quality products. In addition, they gain the trust of consumers. Acquired recognition and reputation allows further existence and development, as well as the advantage over the competition. Participant enterprises in our survey have also stated these benefits of protected intellectual property. In general, the number of patent applications, models and trademarks is rising, which is the case also in Slovenia. This is a good sign of developing economical-entrepreneurship field. However, the efforts of the World Intellectual Property Organisation (WIPO) and other bureaus to inform small and medium enterprises about the importance of protected intellectual property, have not yet achieved significant success. Perhaps the reason for this still lies in the high expenses, even though they can be optimized. It would not be a bad idea to consider introducing relative amounts of official fees in regard to the size of enterprise. If all enterprises had the same relative expenses, ensuring loyal competition and security of smaller enterprises would be easier. The latter are also the ultimate goals of bureaus for protection of intellectual property all around the World.
