Abstract

T.i. CSI efekt in slovenski medijsko odmevni primeri so na laični javnosti pustili vtis, da sodišča strokovnih mnenj Nacionalnega forenzičnega laboratorija ne upoštevajo, ter da forenzični strokovnjaki svojega dela ne opravijo dovolj strokovno. Razne TV nadaljevanke so pustile vtis, da forenzični strokovnjak npr. najdene prstne sledi naloži v računalnik ter malce počaka, da mu le-ta ponudi odgovor oz. pozitivno individualno identifikacijo. Vendar je prikazano delo forenzičnega strokovnjaka v nadaljevankah večinoma zelo daleč od resnice. Namen diplomskega dela je bralca preko prikaza sodne prakse popeljati skozi težave in dejavnike s katerimi so se soočali forenzični dokazi oz. forenzični strokovnjaki v fazi sojenja, in ki so vplivali na to, da slovenska sodišča niso pripisovala forenzičnemu dokazu takšne dokazne vrednosti, kot jo ima danes. Poleg tega je namen raziskati ali so še vedno prisotne, glede na to, da obstajajo različni forenzični dokazi, ki jih lahko razdelimo glede na to ali je forenzični strokovnjak do njih prišel preko subjektivne ali analitske metode, razlike v njihovi dokazni vrednosti pred sodiščem.

Secondary abstract: The so-called CSI effect and Slovenian media high-profile cases left the impression that the courts ignores the opinions of the National Forensic Laboratory at the general public, and that the forensic examiners don’t perform their work enough professional. Various TV series have left the impression that forensic examiner for example founds traces of papillary lines and loads it into the computer and wait a bit for answer or more precisely positive individual identification. However, the forensic examiner work in the movie series is mostly shown very far from the truth. The purpose of this diploma paper is to shown reader through court practice the problems and factors which forensic evidence and forensic experts had to face at the trial stage, and which have influenced on the fact that Slovenian courts haven’t attributed the forensic evidence of such probative value as it has today. Moreover, it is also intention to investigate whether they are still present, according to that different forensic evidences exist, which can be divided considering if the forensic examiner gets them through subjective or analytical method, differences in evidence value before court of justice.
