Abstract

POVZETEK Transplantacija je postopek zdravljenja s pomočjo presajanja organov. Organe pridobljene za namene transplantacije v večini primerov pridobimo od mrtvih darovalcev, lahko pa tudi od živih. Sam način in izvedba postopka transplantacije sta zelo kompleksna. Zagotovljeni morajo biti pogoji, ki se zahtevajo s stališča medicinske stroke, hkrati pa morajo biti v okviru prava izpolnjeni formalni pogoji, da se sam postopek transplantacije lahko izvede. V okviru postopka transplantacije se dejavnost v Sloveniji izvaja pod okriljem javnih zavodov (Slovenija-transplant), ki urejajo in izvajajo postopek od samega začetka. Potrebe po organih za namene transplantacije so vedno večje od dejanske razpoložljivosti organov, ki so potrebni za zdravljenje s tem postopkom. Napredek tehnologije, medicinskih postopkov ter informiranost širše populacije pa pripomore k zagotavljanju boljših možnosti v okviru tega naprednega načina zdravljenja. Potreba in želja po spremembi ureditve tega področja se je pojavila s Pobudo o spremembi tega zakona. Sedanji ZOPDCT, ki ureja to področje, ponuja možnost opredelitve za darovanje po smrti tako, da se darovalec o tem izreče in pridobi kartico Darovalec. S spremembo tega zakona, bi se poenostavil postopek opredelitve in bi se o darovanju po smrti opredelili le tisti, ki temu nasprotujejo. S poenostavitvijo postopka in s spremembami v miselnosti ljudi, pa bi zagotavljali boljše možnosti bolnikom, ki čakajo na presaditev organov.

Secondary abstract: ABSTRACT Organ transplantation is the moving of an organ from one body to another for the purpose of replacing the recipient's damaged or absent organ. Most organs are obtained from deceased donors, but in some cases people donate their organs while they are alive. Organ transplantation procedure is very complex. Conditions that are required from a medical point of view must be provided and also law requirements must be fulfilled so that organ transplantation procedure can be performed. Organ transplantation is provided under the auspices of public institutions (Slovenija-transplant) that regulate and implement the procedure from the beginning to the end. The demand for donor organs drastically exceeds the supply. However, technology progress, medical system and people informed about the transplantation procedure ensure better treatment opportunities. The need to change the legal arrangements of this medical field occurred when the initiative to change the field law was set up. The field law provides different options for donating organs. A person can donate his organs after his death by signing a donor card. Organ donation law changes would simplify the donation process, so that only those who oppose to organ donation would state their decision. Simplification of this procedure and the belief of people would assure better chances for those awaiting transplants.
