Abstract

Diplomsko delo obravnava tematiko italijanske narodne skupnosti, živeče v Sloveniji, nabor njihovih pravic, politično zastopanost na lokalnem in državnem nivoju in pravno podlago za vse to, pri čemer se osredotoča predvsem na sam volilni sistem in volitve predstavnikov skupnosti v različne organe. Poleg zgodovinskega uvoda in pravne podlage za zaščito italijanske narodne skupnosti, avtor v delu analizira pravno podlago za zastopanost in postopek izvolitve predstavnikov italijanske narodne skupnosti v občinske svete, v svete krajevne skupnosti ter v državni zbor. Hkrati avtor obravnava tudi organiziranost skupnosti na lokalnem nivoju na področju kulture, izobraževanja in medijev ter kako se vse to financira. Iz opravljene analize je razvidno, da so bistvenega pomena za zaščito obravnavane skupnosti predvsem določbe iz Ustave kot najvišjega pravnega akta, iz katerega nadalje izhajajo ostali zakoni, ki zadevajo pravice in organiziranost skupnosti. Slovenija je uzakonila načelo pozitivne diskriminacije, ki vsaj na papirju nudi italijanski narodni skupnosti relativno dober položaj. Avtor v zaključku podaja odgovore na zastavljena vprašanja in utemeljuje dejstva, obravnavana skozi diplomsko delo.

Secondary abstract: The subject of this paper is Italian national community living in Slovenia, a set of their rights, political representation on local and national level and the legal basis for all this, focusing particularly on the electoral system and election of representatives of the Italian community into various political bodies. In addition to the introduction of historical and legal basis for the protection of the Italian national community, author analyzes the legal basis for the representation and the election process of representatives of the Italian national community in the municipal councils, the councils of the local community and the National Assembly. At the same time, author deals with the community's organisation at the local level in the field of culture, education and media, and the way how all is funded. The undertaken analysis points out the importance of the constitutional provisions, being the highest legal act, for the sole protection of the treated community and from which are derived other laws affecting the rights and community's organization. Slovenia has enacted the principle of positive discrimination which, at least on paper, gives Italian community relatively good position. In the conclusion, author provides answers to the questions asked and evaluates facts, treated through the work.
