Abstract
Zastavna pravica na nepremičninah oziroma hipoteka je kot stvarna pravica celovito urejena v Stvarnopravnem zakoniku, v delu, ki ureja zastavne pravice. Zastavna pravica je splošno urejena v 128. členu SPZ, ki jo določa kot stvarno pravico na točno določeni tuji stvari ali pravici, ki zastavnemu upniku daje upravičenje, da se zaradi neplačila zavarovane terjatve ob njeni zapadlosti poplača skupaj z obrestmi in stroški iz vrednosti zastavljene nepremičnine pred vsemi drugimi upniki zastavitelja. Ta splošna definicija zastavne pravice se uporablja tudi za hipoteko kot zastavno pravico na nepremičnini, za katero se uporabljajo poleg splošnih pravil o zastavni pravici, še specialne določbe, ki so vsebovane v členih od 138. do 154. SPZ. Hipoteka predstavlja v slovenskem pravnem sistemu najbolj razširjen institut zavarovanja večjih terjatev, saj daje hipotekarnemu upniku visoko stopnjo pravne varnosti. Kot stvarna pravica se vpisuje v zemljiško knjigo, ki je ravno na pragu obsežnih sprememb, predvsem v smislu informatizacije zemljiškoknjižnega postopka.

Secondary abstract: |
Real estate lien or mortgage is as a right in rem fully regulated in the Law of Property Code in section, where it governs liens. Lien is generally regulated in Article 128 of the Law of Property, where it is laid down as a right in another's property or right that gives in the case of nonpayment of insured claims by maturity the lienholder justification to be remunerated along with interest and expenses of pledged property’s value before all other creditors. This general definition of lien is also used for mortgage as a real estate lien, where there are, along with general rules of lien, also special Decisions in use included in Articles 138 to 154 of Law of Property. Mortgage is in Slovene law system the widest institution of insuring larger claims because it gives to the mortgage creditor a high level of law security. As a right in rem it is entered in the land register, which is just on the verge of large-scale changes, especially in terms of informatization of land register process. |
