Abstract

Osrednja tema diplomske naloge je vpliv iger na srečo na družino. Igra spremlja človeštvo že skozi vso zgodovino. Oblikovno in vsebinsko so se igre skozi čas spreminjale, spreminjala pa se je tudi njihova pravna ureditev. Osredotočili se bomo na trenutno pravno ureditev. Tako kot v večini držav članic Evropske Unije, tudi pri nas, v Republiki Sloveniji, velja načeloma prepoved prirejanja iger na srečo, ki pa ni absolutna. Obstajajo namreč tudi izjeme, ki so v domeni posamezne države članice Evropske Unije, ko se ob izpolnjevanju zelo strogih pogojev in pod nadzorom s strani države, igre na srečo lahko prirejajo. V diplomski nalogi bomo pisali prav o teh vrstah iger na srečo, ki se sicer legalno prirejajo, ampak imajo vseeno negativen vpliv na posameznika in družino. Prekomerno igranje na srečo ima lahko poleg možnosti hitrega zalužka tudi negativne posledice za posameznika in družino. Posameznika pogosto pahne na družbeno dno. V takih primerih to pogosto ni več problem posameznika, ampak preraste v problem celotne družine, ki je od tega posameznika popolnoma ali deloma odvisna. Zanimalo nas bo, kako igre na srečo vplivajo na posameznika in družino. Raziskati bomo poskušali, v kolikšni meri je razširjena zasvojenost z igrami na srečo in kakšne so lahko posledice prekomernega igranja na srečo. Na pravnem področju bomo opisali institute, ki so kakorkoli povezani z igrami na srečo in so posameznikom na voljo v skrajnih situacijah in s katerimi lahko škodljive posledice prekomernega igranja na srečo preprečimo ali pa vsaj omejimo. Posegli bomo na področje družinskega, dednega in kazenskega prava. Vključili bomo tudi sodno prakso s tega področja.

Secondary title: IMPACT OF GAMBLING ON FAMILY LIFE
Secondary abstract: The main topic of this diploma is the impact of gambling on the family. Games have accompanied mankind throughout history. Form and substance of games changed substantially over time, and also the organization of them. I this diploma work we will be focusing on the current legal regime of gambling. As in most countries of the European Union, including the Republic of Slovenia, the prohibition of gambling stands in principle, but is not absolute. There are also exceptions, which are organized individually by Member States of the European Union and are under very strict conditions and supervision by the state in which gambling can be held. In this diploma we will be focusing on these types of gambling that is legally organized, but nonetheless has a negative impact on individuals and families. Excessive gambling can have, next to fast earnings, also negative consequences for individuals and families. It can often bring the individual to the social bottom. In such cases, this often is not an individual problem, but turns into a problem for the whole family. We will be focusing on how gambling impacts on individuals and families. We will try to explore to what extent the widespread addiction to gambling is and what are the consequences of excessive gambling. In the legal field, we will describe the institutes that are in any way related to gambling and are available to individuals to prevent excessive gambling or at least limit it. We have compiled an area of family, inheritance and criminal law. We will also include case law examples from this field of research.
