Abstract

V zadnjih letih se zelo uveljavljajo alternativne oblike reševanja sporov. Ena izmed teh oblik je mediacija. Gre za postopek, kjer tretja nevtralna in nepristranska oseba skrbi za dostojen nivo komunikacije med strankama. Mediator v mediacijskem postopku ne odloči o sporu, pač pa stranki vodi, da sami skleneta sporazum, ki bo v interesu obeh. Glavna načela mediacije so zaupnost, prostovoljnost, fleksibilnost in nezmožnost mediatorja za sprejemanje odločitev. Okrožno sodišče v Ljubljani od leta 2001 strankam ponuja možnost alternativnega reševanja sporov. Postopek izvedejo za to usposobljeni mediatorji, npr. sodniki, upokojeni sodniki, odvetniki, socialni delavci ali psihologi. Za še bolj pogosto uporabo mediacije, bo potrebna še večja informiranost strank, s čimer bodo stranke pridobile zaupanje v ta postopek. Diploma predstavi vse značilnosti mediacije: načela, subjekte (mediatorja, mediante, možnost udeležbe odvetnika, otroka itd.), predmet (kaj vse je z družinsko mediacijo možno rešiti), podrobno je opisan postopek sodišču pridružene mediacije, prav tako statistični podatki o njeni uspešnosti in kot verjetno najpomembnejši del – sporazum oz. njegova izvršljivost.

Secondary abstract: In the recent years, the implementation of alternative dispute resolution methods has increased. One of these forms is mediation. It is a process in which a third, neutral and impartial person is enabling a high level of communication between the two parties. The mediator cannot pass a ruling in the dispute, they merely encourages the parties to enter into an agreement which is in the best interest of all involved. The main principles of mediation are confidentiality, flexibility, voluntariness, and inability of the mediator to decide in the dispute. Since 2011, the District Court of Ljubljana has been offering the possibility of engaging in mediation. The process is led by a qualified judge, retired judge, lawyer, social worker, or psychologist. As mediation becomes more frequent, more relevant information is required, ensuring the parties to have more confidence in this process. This thesis presents all features of mediation: the main principles, entities (mediator, clients, the role of lawyers, involvement of children etc.), subject (what can be resolved with mediation), court-mediation in detail, statistics, and probably the most important part – the agreement and its enforceability.
