Abstract
V diplomskem delu sem zajel varstvo človekovih pravic na nadnacionalni ravni, pri čemer sem se najprej osredotočil na opis razvoja tega varstva na globalni, nato pa še na regionalni ravni v okviru Sveta Evrope in EU. Skozi nalogo je prikazana sodna praksa sodišč ESČP in Sodišča EU, pri analizi njunega medsebojnega razmerja pa sem primerjal njuno sestavo, postopek pri njunem odločanju, zgodovinski razvoj, pravne podlage za njuno delo, pravice in svoboščine, ki jih varujeta pri svojem odločanju, kot tudi možnosti dostopa do teh dveh sodišč. Poudarek je podan tudi pri opisu najvidnejših načel, ki skozi sodno prakso usmerjajo njuno delo.
Jedro diplomske naloge je posvečeno pregledu učinkov, ki naj bi jih imela večja naslonitev Sodišča EU na ESČP po uveljavitvi Lizbonske pogodbe kot tudi potencialni pristop EU k EKČP. Zato je v nadaljevanju najprej podano razmerje med EKČP in Listino EU o temeljnih pravicah kot katalogoma človekovih pravic, na katerih sodna praksa teh sodišč temelji, oziroma bo temeljila v prihodnosti. Sledi razlaga sodb Sodišča EU na področju varstva človekovih pravic in primerjava s sodno prakso ESČP, pri čemer sem iskal njune medsebojne sorodnosti, neskladja, kot tudi očitna nasprotja v podanih odločitvah. V luči novih razmerij med njima sem opisal možne učinke, ki bi jih večja naslonitev Sodišča EU na ESČP imela v institucionalnem, ustavnem in normativnem pogledu, ter se ustavil še pri vprašanju večje upravičenosti EU in njene povezanosti s preostalo Evropo. Nadalje sem analiziral učinke, ki bi jih naslonitev imela na odnose med EU in državami članicami EU, ter na koncu razložil tudi tiste možne učinke, ki jih takšna naslonitev utegne imeti na globalna razmerja EU do preostalega sveta.

In this diploma I included protection of human rights at supranational level, and tried to focus first on global and then on regional development of such protection within the EU and the Council of Europe. In my research I also analysed case-law and historical development of European Court of Justice and European Court of Human Rights, legal basis for their work, considering fundamental rights and freedoms being protected. While I analysed their relations, I also focus on their membership, process features, possibilities towards access of these courts and most important principles common to their work.
The core of diploma is dedicated to researching possible effects of enhanced reliance of Court of Justice in Luxembourg on case-law of Court of Human Rights in Strasbourg, after bringing into force Lisbon Reform Treaty and question of potential approach EU to European Convention of Human Rights. Within continuation I underlined relation between the European Convention of Human Rights and the Charter EU of Fundamental Human rights, as we know both documents contain human rights and freedoms and they offer legal basis for their jurisprudence now and in future. Subsequently I analyse judgements of the Court of Justice in the sphere of human rights and compared those with case-law of the Court in Strasbourg, while trying to emphasize similarity, disparities as also conflicts in their decisions. Focus has been also done on enhanced reliance between those courts in institutional, constitutional and normative view, on more legitimate, cohesive European Union and Europe, and on improved relations between the EU and its Member States, as also on the global dimension of such reliance. |
