Povzetek

V diplomskem delu je obravnavana pravica otrok s posebnimi potrebami do enakega dostopa do izobraževanja, proces integracije teh otrok v redno šolo in njihov dejanski položaj. Obravnavana problematika je razdeljena na štiri temeljne dele. Na začetku avtorica opredeli otroke s posebnimi potrebami ter nas seznani s pojmoma inkluzivno izobraževanje in integracija. Sledi kratek prikaz šolanja in izobraževanja otrok s posebnimi potrebami skozi zgodovino. V drugem delu so obravnavane otrokove pravice, poudarek je na pravici do izobraževanja in uresničevanju te pravice pri otrocih s posebnimi potrebami. Navedeni so pomembnejši mednarodnopravni dokumenti, ki zadevajo to problematiko. Sledi pregled nacionalne zakonodaje otrok s posebnimi potrebami ter njihove vzgoje in izobraževanja. Predstavljen je potek usmeritev otrok s posebnimi potrebami, dejanski položaj skozi pregled sodnih odločb. Avtorica v prilogi opravi intervju z deklico, učenko s posebnimi potrebami in njenim učnim spremljevalcem. V zadnjem delu sledi pregled tujih pravnih izkušenj s področja izobraževanja otrok s posebnimi potrebami. Prikazan je proces integracije v Avstriji in primerjava z našo zakonodajo.

Sekundarni povzetek: This thesis confronts with the right of children with special needs to equal access to education, the process of integration of these children in regular schools and the actual situation. The problem in this thesis consists of four main parts. At the beginning, is given a definition of children with special needs and we are acquainted with the concepts of inclusive education and integration. Author points out a brief overview of schooling and education of children with special needs throughout history. The second part deals with children's rights, the emphasis is on the right to education and the achievement of these rights for children with special needs. In addition, the author states international legal acts addressing this issue. In the following part is given a review of national legislation affecting children with special needs and their education. A brief analysis of course direction of children with special need is presented and the actual situation through a review of judicial decisions. At the end author give us an interview with a pupil, who is a child with special needs, and its companion, to show us an actual state of children with special needs in regular school. In the last part, a main focus is on a review of foreign legal experience in the field of education for children with special needs, following by the process of integration in Austria and the comparison with our legislation.
