Povzetek

Korist otroka je osrednje načelo Konvencije Združenih narodov o otrokovih pravicah, veljavnega Zakona o zakonski zvezi in družinskih razmerjih ter predloga Družinskega zakonika. Določa, da je potrebno v vseh dejavnostih v zvezi z otrokom upoštevati njegovo korist. Ugotovitve prakse in spoznanja teorije kažejo, da so v vseh sestavnih delih Zakona o zakonski zvezi in družinskih razmerjih pravne praznine in pomanjkljivosti, pa tudi določena neskladnost z novejšimi mednarodnimi akti, zato je potrebno, da se celovito uredi družinskopravna snov v novem predpisu- Družinskem zakoniku. Predlagana pravna ureditev ukrepov države za varstvo koristi otrok temelji na načelu, da so za otrokovo vzgojo in varstvo odgovorni predvsem otrokovi starši in da mora otrok za poln in skladen razvoj svoje osebnosti odraščati v družinskem okolju. Zato daje poudarek preventivnim ukrepom in milejšim ukrepom, pri katerih otroka ni treba izločiti iz družine. Nova pravna ureditev ureja sistem nujnih ukrepov, začasnih odredb in ukrepov trajnejše narave, ureja enotne pogoje za izrekanje teh ukrepov, takojšnji sodni nadzor utemeljenosti izrečenega ukrepa in nenehno preverjanje, ali je izvajanje ukrepa za varstvo koristi otroka še potrebno. Pomembne novosti se nanašajo na skrbno ločitev pristojnosti sodišča od pristojnosti Centrov za socialno delo, pri izrekanju ukrepov za varstvo koristi otrok ter njihovo medsebojno sodelovanje.

Sekundarni povzetek: Best interests of a child is the main principle in United Nations Convention of the rights of the child, the existing Marriage and family relations Act and new regulation- the Family Code. It stipulates that in all matters concerning children's best interests are to be taken into consideration. Conclusions made on theoretical and practical experience point towards legal voids and insufficiencies throught the existing Marriage and family relations Act, as well as certain non-conformities with international documents. Therefore it is necessary to deal with the subject matter in the new regulation- the Family Code. The proposed statutory regulation of the Measures for the protection of children in founded on a principle that primaraly parents are responsible for the custody of their child and that child should grow up in a family environment in order to develop a full and development of his and her personality. So the emphasis in on the preventive measures and measures, which require no separation of the child from his family. The proposed Family Code regulates a system of emergency measures and measures of permanent character, immediate judicial control over the decision and the periodic review of the threatment provided for the child and other circumstances relevant to his or her placement. Many important novelties are regarding to neccesary divide the competence of the courts from the compitencies of the centres of social work, when they are solving issues of measures for protection of benefit of children and their coorperation.
