Povzetek
Lastninska pravica je ena izmed elementarnih in temeljnih človekovih pravic vsakega pravnega reda. Bistvo njene funkcije je varovati svobodno ravnanje posameznika na premoženjskem področju in svobodno oblikovanje lastnega življenja. Čeprav Ustava Republike Slovenije zagotavlja in varuje pravico do zasebne lastnine, lastninska pravica ni absolutna. V skladu z ustavnimi in zakonskimi predpisi se jo lahko razlasti, oziroma omeji s pravico uporabe za določen čas ali obremeni z začasno ali trajno služnostjo. Postopek omejitve lastninske pravice v javnem interesu ni težaven, če je lastnik nepremičnine znan, drugače pa je v primeru, ko lastnik nepremičnine ni znan. Še preden vloži zahtevo za uvedbo postopka omejitve lastninske pravice, mora razlastitveni upravičenec lastniku nepremičnine vročiti ponudbo za odkup nepremičnine, kot to določa Zakon o urejanju prostora. Če lastnik ni znan, vročitev ponudbeni možna, zato je potrebno postaviti skrbnika za posebni primer neznanemu lastniku ali začasnega skrbnika v nepravdnem postopku. Skrbnika za posebni primer na podlagi Družinskega zakonika, prej veljavnega Zakona o zakonski zvezi in družinskih razmerjih,postavi Center za socialno delo, isti zakon pa omogoča, da skrbnika za posebni primer postavi tudi organ, pred katerim postopek teče. Postopek omejitve lastninske pravice ne more biti uveden, kadar ni znan lastnik nepremičnine, ki bi mu bila lahko vročena ponudba za odkup nepremičnine.Začasnega skrbnika v nepravdnem postopku na podlagi Zakona o dedovanju postavi sodišče. Za primerjavo in zaradi posredne povezanosti s temo diplomske naloge sem obravnaval tudi posledice in rešitve problema(ne)postavitve začasnega skrbnika v nepravdnem postopku na predlog lokalne skupnosti, ki izkazuje javni interes in potrebo po čim hitrejši uvedbi postopka omejitve lastninske pravice z vzpostavitvijo služnostne pravice na zadevni nepremičnini.

Property right is one of the fundamental human rights within any legal order. Its essential function is to protect the individuals' freedom of action in relation to property, as well as freedom of forming one's own life. Although the Constitution of the Republic of Slovenia ensures and protects the right to private property, property right is not absolute. In line with constitutional and statutory regulations, it can be expropriated or restricted by means of a right to use for a definite period of time, or it can be encumbered with temporary or permanent easement. The procedure of public interest restriction of the property right is not difficult if the owner of the real estate in question is known; if the owner is unknown, however, the procedure can become complex. Even before lodging a request to initiate the procedure of restricting the property right, the expropriating party must submit to the owner of the real estate an offer to buy the real estate in question as is stipulated by the Spatial Management Act. If the owner is unknown and it is thus impossible to submit such an offer, a guardian for a specific case must be appointed to represent the unknown owner, or a temporary guardian in a non-contentious proceeding. Pursuant to the Family Code, previously applicable Marriage and Family Relations Act,a guardian for a specific case is appointed by the Social Work Centre, while the same act stipulates that such a guardian may also be appointed by the body before which the procedure in question takes place.The process of restricting the property right cannot be initiated when the owner of the real estate is unknown and thus cannot be submitted the offer to purchase said real estate. Pursuant to the Inheritance Act, a temporary guardian in a non-contentious proceeding is appointed by the court. For the purposes of comparison and due to indirect connection with the topic of the diploma thesis, I also explored the consequences of and solutions to the problem of (non-)appointing a temporary guardian in a non-contentious proceeding at the proposal of the local community that expresses the public interest, as well as the need for initiating the procedure of restricting the property right as soon as possible through the establishment of easement on the real estate in question. |
