Sekundarni povzetek: | The diploma thesis examines the possible legal consequences that arise when the national court of last instance violates its duty to submit a question for a preliminary ruling under the third paragraph of Article 267 TFEU. Initially, the descriptive method is used to define the preliminary ruling procedure and, using the historical method, to review its development and the changes. The historical method and the method of analysis are used to examine the case law. The thesis then focuses on the analysis of the case law of the European Court of Human Rights and from the point of view of the Convention for the Protection of Human Rights and Fundamental Freedoms. While an individual cannot refer a question for a preliminary ruling directly to the Court of Justice of the European Union, a national court’s failure to refer a question without ruling on the party's request for referral to the Court of Justice of the European Union and without stating reasons from the exceptions of the CILFIT case will result in a violation of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms. |
