Povzetek

Namen magistrske naloge je predstaviti temeljne spremembe, ki jih prinaša Zakon o katastru nepremičnin (2021) skupaj s podzakonskimi akti, glede postopkov posamičnega katastrskega urejanja in preurejanja zemljiških parcel, to so ureditev meje, parcelacija in izravnava meje. Posebno pozornost smo posvetili predvsem postopku ureditve meje, ki je pogosto predhodni postopek parcelacije in izravnave meje. Glavni cilj je bil preučiti nove zakonske okvirje, ki jih na področje zemljiškega katastra oziroma katastra nepremičnin postavlja Zakon o katastru nepremičnin, vezane na postopek ureditve meje, deloma tudi na postopka parcelacije in izravnave meje. V okviru raziskave smo podrobno preučili zakonski okvir omenjenih postopkov po veljavnem Zakonu o katastru nepremičnin (ZKN, 2021) in predhodnem Zakonu o evidentiranju nepremičnin (ZEN, 2006), kjer smo upoštevali tudi podzakonske predpise, ki podrobneje določajo vsebino in postopek katastrskih storitev. Na podlagi poznavanja stare zakonodaje in analize nove zakonodaje smo ugotovili, da določila ZKN (2021) omejujejo udeležbo in sodelovanje strank pri postopku ureditve meje in da se je s sprejetjem ZKN (2021) bistveno spremenila možnost strokovnega dela za inženirje geodezije, ki nimajo licence pooblaščenega inženirja. Pomembna sprememba je nadalje vloga Geodetske uprave RS pri postopkih ureditve meje, kjer se je ukinila možnost oblikovanja soglasja o poteku meje v okviru upravnega postopka. Za mnenje glede te spremembe smo se z vprašalnikom obrnili na strokovnjake z geodetske uprave, ki so potrdili domnevo, da je možnost sodelovanja lastnikov pri urejanju meje z novo zakonodajo manjša glede na predhodne zakonske ureditve.

Sekundarni povzetek: The purpose of the master thesis is to present fundamental changes brought by the Real Estate Cadastre Act (2021) together with the regulatory provisions, regarding the procedures of individual cadastral regulations and rearrangements of land parcels, i.e., boundary settlements, subdivisions and boundary adjustments. We paid special attention to the process of border settlement, which is often a preliminary process of subdivision and adjustments of the border. The main goal was to study the new legal framework in the area of the land cadastre or real estate cadastre established by the Real Estate Cadastre Act (2021), related to the process of boundary regulation, partly also to the process of parcel subdivision and boundary adjustment. As part of the research, we examined in detail the legal framework of the mentioned procedures according to the Real Estate Cadastre Act (2021) and the previous Real Estate Records Act (2006), where we also took into account the regulatory provisions that define the content and the procedure of cadastral services in more detail. Based on the knowledge of the old legislation and the analysis of the new legislation, we concluded that the provisions of the Real Estate Cadastre Act (2021) limited the participation and cooperation of clients in the process of boundary settlement and that the possibility of professional work for geodetic engineers who do not have the license of an accredited engineer has changed significantly. Another important change is the role of the Surveying and Mapping Authority of the Republic of Slovenia in the procedures of boundary settlements, where the possibility of forming a consensus on the course of the boundary as part of the administrative procedure has been abolished. For an opinion about this change, we asked the experts from the Surveying and Mapping Authority of the Republic of Slovenia, who confirmed the assumption that the possibility of the owners’ participation in boundary settlements with the new legislation is limited compared to the previous legal arrangements.
