Povzetek
Pritožbeni postopek predstavlja samostojen pravni postopek, ki se izvaja na podlagi 28. člena Zakona o policiji in ga je država dolžna izpeljati na podlagi podane pritožbe. Pritožbeni postopek oziroma pritožbo lahko sproži ali poda vsak, ki meni, da je policist kršil njegove človekove pravice in svoboščine. Skozi diplomsko delo smo predstavili pritožbeni postopek zoper policiste, ki se od februarja 2004 rešuje po Pravilniku o reševanju pritožb, dopolnjujeta pa ga Pravilnik o spremembah in dopolnitvah Pravilnika o reševanju pritožb (2005) ter Pravilnik o spremembah in dopolnitvah Pravilnika o reševanju pritožb (2006). Tako se že osmo leto rešujejo pritožbe na dveh ravneh, in sicer v pomiritvenem postopku pri vodji organizacijske enote policije in na senatu Ministrstva za notranje zadeve. Policisti pa so tisti, ki lahko z danimi pooblastili skoraj v vsaki situaciji opravljajo svoje naloge in ukrepajo na primeren način. Hkrati pa so tisti, ki najgloblje posegajo v človekove pravice in svoboščine, zaradi česar so najbolj izpostavljeni kršitvam, ki zlahka nastanejo pri tako zahtevnem in nevarnem delu, ki nemalokrat zahteva hitro odločanje in ukrepanje, pri velikem številu zakonskih predpisov in policijskih pooblastil, spreminjajoči se tehnologiji ter raznolikosti in nepredvidljivosti človeškega življenja, ki ga tudi zakon nikoli ni mogel predvideti v celoti. Pritožba je zato ena od oblik nadzora nad delom policije, ki pa je v velikem številu primerov podana iz napačnih razlogov, saj je njen namen in učinek pogosto napačno razumljen. V diplomskem delu je narejena tudi analiza statističnih podatkov iz podanih pritožb zoper policiste po delovnih področjih, po policijskih upravah in po pritožbenih razlogih, predstavljena pa je tudi celotna slika podanih pritožb za časovno obdobje od leta 2005 do leta 2011.

The appeal proceeding is a stand-alone legal proceeding implemented pursuant to Article 28 of the Police Act and is supposed to be carried out by the State acting on a complaint received. Both appeal proceeding and complaint respectfully can be initiated or submitted by any person who believes their human rights and freedoms have been breached by a police officer. This diploma paper introduces appeal proceedings against police officers that has been since February 2004 settled pursuant to the Rules on resolving of appeals, complemented by Rules amending the Rules on the settlement of appeals (2005) and Rules amending the Rules on the settlement of appeals (2006). For the past eight years, the appeals have been settled on two levels, in a conciliation procedure with the head of a police organisational unit and with the senate of the Ministry of internal affairs, respectfully. The police officers are the ones who can, in any given situation and according to the powers conferred to them, perform their tasks and act in an adequate manner. At the same time, they are the ones who interfere the most seriously with human rights and freedoms, which makes them exposed to breaches that can easily occur in such a demanding and dangerous line of work that often takes quick decision-making and acting, along with a large number of statutory provisions and police powers, ever-changing technology as well as the diversity and unpredictability of human life which has never been predictable in full not even by the law. An appeal is therefore one of the forms of monitoring police work which, in a large number of cases, gets submitted for the wrong reasons since its purpose and effect are often misunderstood. This diploma paper features statistical analysis of data derived from the appeals submitted against the police officers by work areas, police directorates and reasons for appeal; also, the whole picture of the appeals submitted for the period 2005 to 2011 is being introduced. |
