Povzetek
Samomor je individualno dejanje, ki se tako kot drugod po svetu tudi v Sloveniji ne obravnava več kot kaznivo dejanje. V primeru napeljevanja druge osebe k samomoru pa sicer neinkriminirani samomor postane posebna preiskovalna situacija, kjer je mogoče pomisliti tudi na to, da gre za prikriti umor ali, zelo redko, za nezgodo s soudeležbo tuje krivde. Pri preiskovanju samomora je torej najpomembnejše, da preiskovalci ugotovijo, ali je bila smrt samopovzročena in ali je bila namerna.
Slovenija je ne samo na evropsko, tudi glede na svetovno statistiko v samem vrhu po številu storjenih samomorov. Samomor je pri nas peti najpogostejši vzrok prezgodnje umrljivosti in to je glede na našo majhno Slovenijo zaskrbljujoč podatek. V Sloveniji na leto zaradi samomora umre povprečno 400 ljudi, zato se številne organizacije borijo za preventivne programe, ki bi v ljudeh vzbudile zavedanje o problemu samomora. Svetovna zdravstvena organizacija (WHO) opozarja na to, da je treba zmanjšati tako imenovano stigmo o samomoru, in da gre za prezgodnjo umrljivost, ki jo je mogoče preprečevati. Lahko bi rekli, da so vsi poskusi samomora in neuspeli samomori že nekakšni klici na pomoč, in da je v takih primerih pomembno, da se osebi, ki razmišlja o samomoru, prisluhne in pomaga. Reševanja tovrstnega problema se poslužujemo na preveč sramežljiv način, kajti še vedno je med ljudmi samomor tabu tema. O samomoru moramo čim večkrat glasno spregovoriti tako med laiki kot med strokovnjaki. To nam bo pomagalo pri vzpostavitvi realnejšega odnosa do pojava in ljudi, povezanih z njim. Zmanjšali se bodo strahovi in nelagodja, verjetno pa tudi številni miti, ki se še vedno prepletajo okoli samomora in nenazadnje zavirajo pravočasno ukrepanje.

Between everyday stories we often find titles about murders in families, where in most cases go for a fight between partners. Their back groundings are different; however all arouse density and indignation. Public expectations in these cases are huge and with that there also falls bigger pressure on the investigators. This was in the analyzed case even larger, because the victims of the offender were their two children, who as their mother trusted her most. First who comes to the crime scene (emergency medicals, eyewitnesses, police officers), are the most important source of information for the investigators, because places of crime scene are often changed. It is typical, for these kinds of murder that they are done behind closed doors, away from the eyes of public and because of that some conditions can be unexplained. Unknowing the motif can present huge obstacle for investigators or can even lead in the wrong way. To prove crime act it is crucial that investigators in the faze of examination do their job professionally and in accordance with their profession principles. Overlooked or wrong secured traces and other examination mistakes can be used in pre-trial procedure by advocates of defendants, and these can shake professionalism and reputation of the investigators. To success and relatively fast solution of the case can sufficiently aid to solution good collaboration and information exchange between detectives, investigation judge and state prosecutor. Key parts for conviction defendant were personal evidence that prevailed over material. Despite the fact that they could not prove motif of the offender and that problem show inexistence materials of execution, were for the charge enough personal depositions of examination witnesses, results of detectives technical investigations and expert opinions of experts in the field of psychiatry and clinical psychology. |
