Povzetek
V diplomski nalogi bom predstavila mehanizme nadzora nad novimi psihoaktivnimi snovmi v RS in EU ter probleme, ki so povezani z vzpostavitvijo učinkovitega zakonskega nadzora nad novimi psihoaktivnimi snovmi.
Evropski center za spremljanje drog in zasvojenosti z drogami opredeli novo psihoaktivno snov kot narkotično ali psihotropno drogo v čisti obliki ali v pripravku, ki ni pod nadzorom v skladu z Enotno konvencijo Združenih narodov o mamilih iz leta 1961 ali Konvencijo Združenih narodov o psihotropnih snoveh iz leta 1971 in ki lahko pomeni podobno nevarnost za javno zdravje kot snovi, naštete na seznamih teh konvencij.
Vse države članice EU se srečujejo z naraščajočim pojavom novih psihoaktivnih snovi, ki zaradi njihove široke dostopnosti (internet) predstavljajo tveganje za zdravje posameznika in javno zdravje. Osnovni problem je, da nove psihoaktivne snovi niso uvrščene na seznam prepovedanih drog, dodaten problem pa predstavljajo dolgotrajni zakonodajni postopki v državah članicah za vzpostavitev ustreznega zakonskega nadzora nad novimi psihoaktivnimi snovmi. Zapleten in dolgotrajen mehanizem za nadzor nad novimi psihoaktivnimi snovmi na ravni EU se kaže kot dokaj neučinkovit. Vzpostavitev nadzora nad novo psihoaktivno snovjo lahko spodbudi iskanje in nastanek nenadzorovanega nadomestka. Pomanjkanje znanstvenih študij o škodljivih učinkih novih psihoaktivnih snovi dodatno otežuje zakonske postopke nadzora.
Namen in cilj diplomske naloge je ugotoviti obseg pojava in vrsto novih psihoaktivnih snovi v Sloveniji in EU ter odzivanje držav članic in EU v smislu ustreznega zakonskega nadzora nad novimi psihoaktivnimi snovmi. Opravila bom primerjalno študijo različnih modelov nadzora (individualni, generični in analogni princip) v državah članicah EU ter predlagala možne zakonske rešitve za učinkovitejši nadzor nad novimi psihoaktivnimi snovmi v Sloveniji.

In this dissertation, I will present the mechanisms of control of new psychoactive substances in the Republic of Slovenia and the EU, as well as problems related to the establishment of an effective control of the new psychoactive substances.
European centre for monitoring of drugs and drug addiction defines new a psychoactive substance as a narcotic or a psychotropic drug in pure form or in a preparation, which isn't controlled under the united nations single convention on narcotic drugs of 1961, united nations convention on psychotropic substances of 1971, or which could be a threat to public health in the same way as the substances listed in the conventions above.
All EU members are facing the increased presence of new psychoactive substances due to their wide availability (Internet), which presents a risk factor to the health of the individual and public health. The basic problem is that the new psychoactive substances are not on the list of banned drugs. An additional problem are also the lengthy legislative procedures in member states for the establishment of an appropriate regulatory control of new psychoactive substances. A complex and time consuming mechanism for the control of new psychoactive substances on the EU level has been shown as relatively ineffective. Established control of new psychoactive substances can encourage the formation of uncontrolled search and replacement. The lack of scientific studies on the effects of new psychoactive substances makes control procedures even more difficult.
The purpose and goal of the dissertation is to determine the extent of and type of new psychoactive substances in the EU and the member states as well as the way they will respond and control new psychoactive substances. I will carry out a comparative study of various models of supervision (individual, generic and analogue system) in EU member states and propose possible legal solutions for more effective control of new psychoactive substances in Slovenia. |
