Povzetek

Zaradi dejstva, da je zaposlitev žensk postala nekaj vsakdanjega, je običajno, da ženska poleg dela v službi skrbi še za dom in družino. Ženske se zaposlujejo predvsem zato, ker si želijo biti ekonomsko neodvisne ter hkrati uveljavljati svoje sposobnosti tudi zunaj doma. Vendar se delavke matere pri zaposlovanju srečujejo s številnimi težavami. Eden glavnih problemov, s katerimi se srečujejo delavke matere, je problem usklajevanja družinskih in delovnih obveznosti ter s tem bojazen pred odpovedjo pogodbe s strani delodajalca zaradi nosečnosti. Manj ugodno obravnavanje zaradi nosečnosti ali starševstva je namreč prepovedano. Temeljni cilj na področju delovnega prava je zato zagotavljati varstvo delavk mater že pred sklenitvijo pogodbe o zaposlitvi in med trajanjem delovnega razmerja tako v času nosečnosti kot v času, ko delavka še doji. V diplomskem delu so predstavljeni in razčlenjeni pravni viri, ki so oblikovani z namenom zagotavljanja varstva tem skupinam delavk. Predstavljeni so domači pravni viri ter mednarodni pravni viri, ki predstavljajo ključno izhodišče za oblikovanje slovenske zakonodaje. Naša zakonodaja je namreč v slovenski pravni red na področju delovnega prava vnesla številne norme mednarodnega delovnega prava s področja varstva delavk mater, saj zaradi svojega šibkejšega položaja potrebujejo posebno delovnopravno varstvo. Podrobneje so predstavljeni posebno varstvo delavk zaradi starševstva in nosečnosti v Republiki Sloveniji in pravice, ki so jim zagotovljene v okviru tega varstva. Pri tem je vključena slovenska sodna praksa in sodna praksa Sodišča Evropske unije, ki pomembno vpliva na razumevanje obravnavane teme v našem prostoru. Pomembno je namreč, da delavke matere poznajo svoje pravice in obveznosti, ki so določeni tako na nacionalni kot na ravni Evropske unije. V diplomskem delu je predstavljena tudi nemška ureditev varstva delavk mater.

Sekundarni povzetek: Working women have become a part of everyday life, therefore, it is typically expected of them, in addition to professional success, to take care of their home and family. Women usually start working because they want economic independence and they wish to put their capabilities into practice also outside the family life and housekeeping. However, working mothers are confronted with a number of obstacles. One of the main problems is the difficulty of combining the family and work obligations, accompanied by the fear of being made redundant by the employer due to their pregnancy. It is against the law to discriminate against a person on the basis of pregnancy or parenthood. The main purpose of the labour law is thus to ensure the protection of working mothers both before the conclusion of the employment contract and during the employment relationship, including during pregnancy and the breastfeeding period. This undergraduate dissertation presents and analyses the sources of law, formed in order to ensure the protection of these groups of workers. National sources of law as well as international sources of law, which represent the fundamental basis for the formation of Slovene legislation, are presented. Slovene legislation incorporated numerous norms of international labour law regarding the protection of working mothers because they, due to their particular situation, need special protection. The undergraduate dissertation focuses on special protection of workers, needed due to parenthood and pregnancy, in the Republic of Slovenia and on the rights originating from this protection. The Slovene case law and the case law of the Court of Justice of the European Union, which exerts an important influence on understanding of this subject in Slovenia, are also included. It is important that working mothers are aware of their rights and duties, determined at the national and European levels. This undergraduate dissertation also includes an overview of the regulation of protection of working mothers in Germany.
